Resolution No. JL12
WHEREAS, commercial fishing is an important industry in
the County of Hawaii providing sources of employment for the
people and revenue for the County; and
WHEREAS, sport fishing is a source of attraction for
visitors from other counties and the remainder of the United
States; and
WHEREAS, the abundant presence of certain species of porpoises
and whales have significantly reduced the catches of tuna
by commercial fishermen and consequently the demise of certain
fishing activities; and
WHEREAS, "catches" by sport fishermen have greatly
decreased because of the presence of certain species of porpoises
and whales; and
WHEREAS, the moratorium on the "taking" of porpoise and
whales by the Marine Mammals Act of 1972, 16 U.S. 1361 et' seq.,
has acted to further threaten the ecological balance of porpoises
and whales to tuna and fishermen; and
WHEREAS, the effect of the Marine Mammals Act has created
great hardship on the Hawaiian commercial fishing industry and
sport fishing,
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
COUNTY OF HAWAII that a recommendation be made to the Hawaii
delegation to Congress to seek immediate relief of this critical
problem by means of an exemption to the Act.
BE IT FURTHER RESOLVED that the delegates to Congress seek
a Marine Mammal research grant for a solution leading to the
protection and conservation of certain marine mammals and to the
fishing industry of Hawaii.
BE IT FURTHER RESOLVED that the County Clerk is hereby
authorized and directed to transmit true copies of this
resolution to the Honorable John A. Burns, Governor, State of
Hawaii; Honorable Daniel K. Inouye, Senator, U.S. Senate;
Honorable Hiram L. Fong, Senator, U.S. Senate; Honorable
Patsy T. Mink, Member of Congress, U.S. House of Representatives;
and Honorable Spark M. Matsunaga, Member of Congress, U.S. House of
Representatives.
