Resolution No. 129
RESOLUTION CONFIRMING AMOUNT AND DENOMINATIONS OF BONDS,
WITH THEIR RESPECTIVE NUMBERS AND DATES OF MATURITIES,
TO BE ISSUED FOR IMPROVEMENT DISTRICT NO. 15, WILDER ROAD
IMPROVEMENT, KAUMANA, COUNTY OF HAWAII, HAWAII, AND
AMENDING PARAGRAPH 8 OF RESOLUTION NO. 118.
WHEREAS, by Resolution No. 118 adopted by this Council
on September 12, 1973, Improvement District Bonds for Improve-
ment District No. 15, Wilder Road Improvement, Kaumana, County
of Hawaii, Hawaii, in the amount of $1,245,000 (less the total
amount of assessments paid on or before October 2, 1973, if
.any) were authorized for issuance and sale;
WHEREAS, it appears by certificate of the Director of
Finance that assessment Nos. 1 through 6 and 8 through 101,
both inclusive, in the total amount of $61,500.00, were paid
on or before October 2, 1973, and that no other assessments
were so paid;
WHEREAS, the total amount of unpaid assessments is
$1,183,500.00;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
COUNTY OF HAWAII, STATE OF HAWAII:
1. That in conformity with the provisions of said
Resolution No. 118 the total amount of bonds to be issued is
$1,183,500.00 and the denominations of said bonds with their
respective numbers and dates of maturity are as shown on
Exhibit "A" hereto.attached and made a part hereof by ref-
erence; and that same are hereby confirmed as being in
conformity with said Resolution No. 118.
2. That paragraph 8 of said Resolution No. 118 be and
the same is hereby amended to read as follows, to wit:

"On the basis of the facts, estimates and
circumstances now in existence and reason-
able expectations with respect to what
will occur in the future the Director of
Finance is prepared to certify that it is
not expected that the proceeds of the issue
will be used in a manner that would cause
such obligation to be arbitrage bonds
under Section 103(d) of the Internal
Revenue Code. Such certification shall
be delivered to the purchaser of the
bonds at the time of delivery of the
bonds."
