AN ORDINANCE AMENDING CHAPTER 24 OF THE HA W AI' I COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO VEHICLES AND TRAFFIC. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAW AI'I: SECTION 1. Purpose. The purpose of these amendments is to revise "no parking" areas along Kalanianaole Street to better address parking needs and safety concerns for pedestrians and bicyclists, and to otherwise match field conditions as deemed appropriate based on field visits. SECTION 2. Chapter 24, article 10, division 5, section 24-280, schedule 28 (No parking at anytime), paragraph (c), South Hilo, of the Hawai'i County Code 1983 (2005 Edition, as amended), is amended by making the following additions and deletions, with the resulting subparagraphs to be appropriately numbered and to read as follows: "(47) Kalaniana'ole Street, [makai]north side, [beginning at]from a point [four tenths of a mile west of Leleiwi Street and extending three hundred twelve ] five hundred eighty feet west of Oeoe Street and extending five hundred seventy-one feet in the westerly direction." "(48) Kalaniana'ole Street, [mauka]south side, from Kamehameha A venue to a point [one hoodred] sixty-three feet west of the Seaside Restaurant driveway." "(49) Kalaniana' ole Street, [beginning at Fisherman's cove and extending one hundred eighty three feet in the southv/csterly direction until the first parking stall on Banyan Way] north side, from a point five hundred eighteen feet east of Banyan Way extending five hundred eighty-one feet in the westerly direction." "[(50) Kalaniana'ole Street, makai side, beginning at the east end of the concrete rock viall on the northeast side of the access road to the James Kealoha Park and extending one hundred seventy feet in the '.vested)' direction.]" "(51) Kalaniana'ole Street, [mauka]south side~ from a point [ffil:e hundred]eighty-three feet east of the Seaside Restaurant driveway to Leleiwi Street." "(52) Kalaniana'ole Street, north side, from a point eight hundred [:fi.fty]ninety-one feet west of Onekahakaha Beach Road and extending [westward to L^...papane Street]seven hundred forty-five feet in the westerly direction." "() Kalaniana'ole Street, north side, from a point fifty-seven feet east of Leleiwi Street and extending five hundred feet in the westerly direction. " "() Kalaniana'ole Street, north side, from a point three hundred fifteen feet west of Uwau Street and extending four hundred ninety-three feet in the westerly direction." SECTION 3. Chapter 24, article 10, division 5, section 24-281, schedule 29 (Parking prohibited during certain hours on certain streets; tow-away zone), paragraph (c), South Hilo, subparagraph (12) of the Hawai'i County Code 1983 (2005 Edition, as amended), is amended to read as follows: "(12) Kalaniana'ole Street, [mauka]south side, from a point [ffil:e hundred]sixty-three feet west of the Seaside Restaurant driveway and extending [twe]one hundred [scvcnteen]fifty-eight feet in the easterly direction except between the hours of 5:00 p.m. and 10:00 p.m." SECTION 4. Material to be repealed is bracketed and stricken. New material is underscored. In printing this ordinance, the brackets, bracketed material and stricken material and underscoring need not be included. SECTION 5. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications 2 of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable.
