Pursuant to Section 92-5(a)(4), Hawai'i Revised Statutes, as amended,
we request attorney-client confidential discussion in executive session to consult with the County
Council on questions and issues pertaining to its powers, duties, privileges, immunities and
liabilities regarding the above referenced cases. We ask that the above referenced case be placed
on the County Council's agenda for December 16,2009, in Kona.
