Your Committee on Human Services and Economic Development, to which was referred
Resolution 237-09, reports as follows:
Resolution 237-09, transmitted by Council Member Emily I. Naeole, dated September 10, 2009,
urging Hawaii State and Federal legislators to amend vaccine laws to include the right of
medical, religious and philosophical exemption from mandated vaccination programs.
Council Member Emily I. Naeole stated that this resolution is in response to constituents who
have contacted her concerning the potential mandatory swine flu vaccinations. Through research
she found that there are many laws that have been put in place to enforce mandatory vaccines
and that all the exemptions have been removed. Even medical exemptions have been eliminated
which means everyone will be forced under the new laws to be vaccinated or go into quarantine.
Furthermore the Federal government has removed all liability from pharmaceutical companies
suppling the vaccine.
Testimony was heard from approximately 30 citizens from Kona, Waimea, and Puna all in
support of this resolution. Chair Naeole relinquished her chair to Vice Chair Yoshimoto to be
able to participate in the disucssion.
Council Member Naeole proposed an amendment via Comm. 525. 1, which amends the second
WHEREAS to correct and clarify what the MSEHPA (Model State Emergency Health Powers
Act) actually states; the fourth WHEREAS by deleting everything after bacterial materials; and
the ninth WHEREAS was deleted in its entirety. The motion was unanimously approved with
little discussion. Ms. Naeole then called for the question which failed due to lack of two-thirds
majority ayes.
Council Member Ford moved to postpone until opposing expert opinions could be presented.
However, Council Member Greenwell pointed out that by failure to show those opposing the
resolution have already spoken with their silence, and the motion to postpone failed.
The Committee on Human Services and Economic development is in accord with the purpose
and intent of Resolution 237-09, as amended to Draft 2 , and recommends its adoption.
