RE: Police Report for Month of September, submitted to Committee for Public Safety,
Parks & Recreation

In the last hearing that Committee for Public Safety, Parks & Recreation held for
"Communication 572" Tuesday October 15, 2009 Mr. Jay Kimura, County Prosecutor &
Police Chief Harry Kuborjiri were present and both admitted openly to violations of the
ordinance.
Peaceful Sky Alliance continues to receive calls with complaints about helicopter flights
over subdivisions. The complaints are about the persistent noise and complaints about
low flying helicopters, There is no adequate procedure to receive complaints.
In order to provide protection to the community at large, the first action to be taken is for
Hawai'i County Council to act to implement the grievance procedures as prescribed by
the Ordinance. These procedures should have been implemented in a timely manner
immediately after the ordinance was passed, a year ago this week. The fact that there are
no grievance procedures constitutes negligence on the part of the County of Hawaii.
Further, we are not aware that the Committee for Public Safety, Parks & Recreation have
yet addressed open violations of the report submitted by the Chief of Police for August
2009.
Further, the law makes it illegal for Hawaii County to accept any funds for marijuana
eradication. This is written into the law and this point must be addressed by Council.
Again, by ignoring this point, this is yet another instance where County is negligent of its
duties.
