Subject: Opposition to Bill 132 rC3UNT.Y. ? i(= HAWN1
Chair Yoshimoto and Members of the Hawaii County Council,
I would urge the Council not to pass Bill 132 on to second reading. I have previously submitted
written testimony against this bill because it does not appear to be within the council's authority.
According to the Charter, the council is to be the legislative and policy making body of the county.
It is the duty of the administration to carry out the directives of the laws and policy that the council
sets forth. By passing Bill 132 which would require the council to administer the law, would usurp
the administration's authority and violate the basic democratic principle of the separation of
powers.
I firmly believe that the county council does not have the authority to pass Bill 132 and as such,
strongly oppose the passage of this bill and urge the council to vote in the negative on Bill 132.
Although the there appears to be a strong public push for the passage of this bill, it flies in the face
of on the basic tenants that this great country and our government is built on. I would hope the
introducer of this bill realizes this.
