Pursuant to H.R.S. Section 342D-7(i), Hawaii Revised Statutes, the State Department of Health
(DOH) seeks written comments from interested persons regarding the following. Osamu & Naoko
Kaneko, contact person Ms. Geri F. Stephens, A TR Properties, Inc., 75-5660 Kopiko Street Suite A-5,
Kailua-Kona, Hawaii 96740 has applied for a variance for the maximum of five (5) years as stated in the
variance application from Hawaii Administrative Rules (HAR) Section 11-62-31.1(a)(1)(C) "General
requirements for individual wastewater systems. Individual wastewater systems may be used as a
temporary on-site means of wastewater disposal in lieu of wastewater treatment works under the following
conditions: Developments involving dwellings. Area of the lot shall not be less than 10,000 square feet
except for lots created and recorded before August 30, 1991. For lots less than 10,000 square feet which
were created and recorded before the August 30, 1991, only one individual wastewater system shall be
allowed." and Section 11-62-31.1(b)(2) Whenever an individual wastewater system is allowed under
subsection (a) the following shall apply: (2) A building may use more than one individual wastewater
system where each individual wastewater system shall connect to a single dwelling unit;.... and Section
11-62-32 Spacing of individual wastewater systems state "No individual wastewater system shall be
located at any point having less than the minimum distance indicated in Table II attached to this chapter in
appendix F, entitled Tables, dated April 15, 1997 and located in the end of this chapter unless otherwise
approved by the director."
Mr. Theodore Baldau, Vice President of RT Engineers, Inc., P.O. Box 390628, Kailua-Kona, Hawaii
96740, is the individual authorized to act for the applicant. The applicant is proposing that the existing
cesspools be converted to seepage pits for each of the two (2) proposed individual wastewater systems
(IWSs) to be connected to four (4) dwelling units on an area of 7,500 square feet. Further, the set back is
less than the minimum of nine (9) foot property line setback. The property, Kona Lanai Apartments is
located at 75-5742 Alahou Street, Kailua-Kona, Hawaii 96740 TMK (3) 7-5-022: 063.
The applicant has made the following comments.
1. The existing apartment building was constructed in 1969 and the area of the lot on which
the Kona Lanai Apartments sits is 7,500 square feet. Two individual wastewater systems
are proposed for the Kona Lanai Apartments.
2. Each of the two proposed individual wastewater systems will be connected to four dwelling
units.
3. The existing cesspools that are proposed to be converted to seepage pits are set back less
than the minimum 9 foot property line setback as identified in Appendix F, Table II.
4. The area of the lot is 7,500 square feet. This is insufficient to meet the minimum land area
requirements for IWS utilization which is one IWS per 10,000 square feet of lot area.
5. Each of the two proposed individual wastewater systems will be connected to four dwelling
units.
6. The existing cesspool that are proposed to be converted to seepage pits are set back less
than the minimum 9 foot property line setback.
7. The existing large capacity cesspool(s) must be closed and replaced with a new treatment
individual wastewater system by April 5, 2005 to comply with federal requirements.
8. The current State requirement of a wastewater treatment plant would significantly add to
the construction cost as well as require a much greater outgoing maintenance cost.
9. The cost of providing an individual wastewater system for each dwelling unit would be cost
prohibitive.
10. The applicant believes this variance request is in the public interest because the LCC will
be upgraded to an IWS (septic system). The IWS plans will be designed by an engineer

and will be submitted to DOH for review and approval. The new IWS will provide a better
wastewater treatment system compared to the existing LCC. Therefore, impact to the
environment will be minimized.
11. Prevent loss of affordable housing. The cost of providing individual wastewater systems to
each dwelling unit would cause an increase in the cost of affordable housing currently
available at the facility.
12. The existing LCC will be upgraded to an IWS (septic system). The IWS will provide a
better treatment system prior to effluent disposal. The IWS will be designed and
constructed to meet the Department of Health standards. The impact to the environment
will be minimized compared to the current wastewater disposal.
13. The proposed treatment individual wastewater systems will provide greater protection than
the large capacity cesspools. The proposed IWS is an improvement to the existing
cesspool in terms of wastewater treatment. The septic tank will provide pretreatment and
sludge removal prior to effluent disposal.
14. The residents of the Kona Lanai Apartments are essentially economically depressed.
The owner of the facility simply cannot afford to build and operate wastewater systems
meeting all the requirements of HAR Chapter 11-62 such as small aerobic wastewater
treatment plants.
15. Wastewater Calculation for Kona Lanai Apartments TMK (3) 7-5-022: 063:
Allowable daily wastewater qeneration
Total area of parcel: 7,500 square feet.
Lot was created before August 30, 1991.
Maximum allowable wastewater = 1,000 gal per day.
Proiected Flow
Number of Dwelling Units: 8 one-bedroom units.
8 bedrooms x 200 gallons per bedroom per day = 1,600 gallons per day.
16. The variance is requested for the maximum of five (5) years.

this application for variance but can not be shown here. If you would like to review the complete

The area of the lot is 7.500 square feet. This is insufficient to meet the minimum land
area requirement for IWS utilization which is one IWS per 10,000 square feet of lot area.
Each of the two proposed individual wastewater systems will be connected to four
dwelling units.
The existing cesspools that are proposed to be converted to seepage pits are set back less
than the minimum 9 foot property line setback.
