STATE OF HAWAII BILL NO. 189 AN ORDINANCE AMENDING CHAPTER 7, ARTICLE 2, SECTION 7-8 OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO CIVIL DEFENSE, DISASTER CONTROL. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI`l: SECTION L The purpose of this measure is to regulate the use of water spigots and to update water hauling charges during times of declared emergency. SECTION 2. Chapter 7, article 2, section 7-8, of the Hawaii Comity Code 1983 (2005 edition, as amended), is amended to read as follows: Section 7-8. Water spigots and water hauling charges. (a) If within any district of the County, upon a declaration of an ernergency by the mayor, residents request that water be hauled to their residences, they shall pay the. [(d) The County shall make water- available for- hatiling at no ehafge to each fequesting •] (b) Where water spigots are provided for under this Chapter, it shall be for residential cooking and drinking use only and subject to the following: (1) A limit of fifty-fivealg lons per dam and (2) The container size shall be no more than fiftv-five Lallons. SECTION 3. Material to be repealed is bracketed and stricken. New material is underscored. In printing this ordinance, the brackets, bracketed and stricken material and underscoring need not be included. SECTION 4. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 5. This ordinance shall take effect upon its approval.
