I.as (Draft 2) ORDINANCE NO. ®0 12 AN ORDINANCE AMENDING CHAPTER 24, OF THE HAWAII COUNTY CODE 1983 (1995 EDITION), RELATING TO VEHICLES AND TRAFFIC. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Chapter 24, article 10, division 5, section 24-280, schedule 28 (No parking at anytime), subsection (c) South Hilo, of the Hawaii County Code 1983 (1995 edition), is amended by deleting the following item: [(75) Kilauea Avenue, both sides, between Kawailani Street and Ohea Street.] SECTION 2. Chapter 24, article 10, division 5, section 24-281, schedule 29 (Parking prohibited during certain hours on certain streets; tow-away zone), subsection (c) South Hilo, of the Hawaii County Code 1983 (1995 edition), is amended by deleting the following item: [(13) Kilauea Avenue, mauka side, beginning at a point one hundred feet Hamakua of the Waiakeawaena School Cafeteria driveway and extending for a distance of one hundred seventy feet in the Hamakua direction from 7:15 a.m. to 8:00 a.m. on school days; 1:45 p.m. to 2:30 p.m. on Mondays, Tuesdays, Thursdays and Fridays when school is in session; and 12:45 p.m. to 1:30 p.m. on Wednesdays when school is in session.] SECTION 3. Chapter 24, article 10, division 6, section 24-287, schedule 35 (Passenger loading zones), subsection (c) South Hilo, of the Hawaii County Code 1983 (1995 edition), is amended by adding the following to be appropriately numbered and to read as follows: f,~ Kilauea Avenue, mauka side, from a point three hundred eighty-three feet Puna of Kawailani Street and extending two hundred thirty-five feet in the Puna direction from 7:15 a.m. to 8:00 a.m. and from 1:00 n.m. to 3:00 p.m. on school da}_s. SECTION 4. Material to be repealed is bracketed. New material is underscored. In printing this ordinance, the brackets, bracketed material and underscoring need not be included. SECTION 5. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 6. This ordinance shall take effect upon its approval.
