Home My WebLink AboutRES 115 Draft 01 1959 Q IZ D - COUNTY OF HAWAII - TERRITORY OF HAWAII RESOLUTION NO. 115 RESOLUTION DIRECTING LAND OWNERS OWNING PROPERTY ON THE NORTH OR HAMAKUA SIDE OF FURNEAUX STREET BETWEEN KAMEHAMEHA AVENUE AND KEAWE STREET, IN THE CITY OF HILO, COUNTY AND TERRITORY OF HAWAII, TO CONSTRUCT SIDEWALKS AND CURBS. WHEREAS, the County of Hawaii deems it proper and necessary that a sidewalk and curb be constructed on the North or Hamakua side of Furneaux Street between Kamehameha Avenue and Keawe Street, in'the City of Hilo, County and-Territory of Hawaii, as provided in Ordinance 10 of the Revised Ordinances of the County of Hawaii 190, and as amended by Ordinance 55 of the ordinances of the County of Hawaii; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS of the County of Hawaii that the owners of property located on the North or Hamakua side of Furneaux Street between Kamehameha Avenue and Keawe Street, in the City of Hilo, County and Territory of Hawaii, are hereby authorized and directed to construct sidewalks and curbs and grade, as provided in Ordinance 10 of the Revised Ordinances of the County of Hawaii 197, and as amended by Ordinance 55 of the Ordinances of the County of Hawaii. BE IT FURTHER RESOLVED that the County Clerk of the County of Hawaii be and he is hereby authorized and directed to send a Written notice as provided in said Ordinances 10 and 55 to the property owners affected hereby. No----------------------------- REVISED LAWS OF HAWAII 1945: CHAPTER 1200 HIGHWAYS, SIDEWALKS, PARKS; USE OF STREETS, ETC. Sec. 6130. Honolulu, Hilo. After the establishment of the grades of streets in Honolulu and Hilo, as by law prescribed, the board may require the owners of the land adjoining any street, the grade of which has been established, to con- struct, maintain and repair sidewalks, including curbs, in accordance withthe grade of the street and to comply with the regulations regarding the material and construction of the same. (As Amended) Sec. 6131. Procedure on owner failing to build, maintain or repair. Lien. If any such owner, after receiving notice to construct, maintain or repair his sidewalk or sidewalks, including curbs, as provided in section 6130, shall neglect or refuse to comply with such order or direction for sixty days after notice, the board may proceed to construct, maintain or repair the same at the expense of the owners The expense shall be a lien on the property in front of which the same is constructed, maintained or repaired and the board may, in the name of the county, recover the amount of the lien and the expense and costs of the same, by action at law in assumpsit, or by any action allowed by law and equity, or that may be prescribed by statute, including any proceeding allowed for the foreclosure of tax liens. ~2< ntt , Rea.
