OS) JLGSO 168 (DRAFT 2) AN ORDINANCE AMENDING CHAPTER 18, ARTICLE 4, SUBSECTION 18-90(h), OF THE HAWAI'I COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO PUBLIC TRANSPORTATION. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAW AI'I: SECTION 1. Findings and Purpose. The Hawai'i County Council, in amending Section 18-90(h), of the Hawai'i County Code 1983 (2005 edition, as amended), seeks to extend the County-wide transportation k6kua zone to June 30, 2011. SECTION 2. Chapter 18, article 4, section 18-90(h), of the Hawai'i County Code 1983 (2005 edition, as amended), is hereby amended to read as follows: (h) Island-wide transportation free zone. (1) The purpose of this subsection is to provide the public with a transportation alternative to the private automobile. The provision of an effective public transportation system for the residents of the County of Hawai'i will produce economic, social and lifestyle benefits for the residents of Hawai'i County. The distances residents must travel for work, medical, education, and social needs will be alleviated by providing public transportation at no cost to the user. (2) The County of Hawai'i shall be designated a transportation k6kua zone. Riders boarding and alighting any regularly scheduled bus route operated by the County of Hawai'i or its designee shall ride free of charge. (3) The transportation k6kua zone shall not apply to County contracted shared-ride taxi services, County operated curb to curb van services, or County operated non-scheduled bus services. (4) The County wide transportation k6kua zone shall terminate on [December 31,2009.] June 30, 2011. (5) Within one year of the k6kua zone's effective date, and again not later than ninety days prior to [December 31, 2009,] June 30, 2011, the transit administrator shall report to the Hawai'i County council on the impact of its implementation. SECTION 3. Material to be repealed is bracketed and stricken. New material is underscored. In printing this ordinance, the brackets, bracketed and stricken material and underscoring need not be included. SECTION 4. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 5. This ordinance shall take effect upon its approval.
