HomeMy WebLinkAboutORD 2000-081 1998-2000 MKr of p.°aY~ cP'•, COUNTY OF HAWAII _ ~ STATE OF HAWAII 64 ~ a o / ~~f! ~i:~~K~~ BILL NO. 267 ORDINANCE NO. 00 B1 AN ORDINANCE AMENDING CHAPTER 24 OF THE HAWAII COUNTY CODE 1983 (1995 EDITION), RELATING TO VEHICLES AND TRAFFIC, AUTHORIZING THE ESTABLISHMENT OF A VOLUNTEER DISABLED PARKING PROGRAM. SECTION 1. The purpose of this ordinance is to establish a volunteer disabled parking enforcement prognam within the Hawaii County Police Department to assist in the enforcement of county and state disabled parking laws on public and private property. SECTION 2. Chapter 24 of the Hawaii County Code 1983 (1995 Edition) is amended by adding a new section, to be appropriately numbered and to read as follows: Sec. 24 - .Volunteer disabled parking enforcement program. La,2 For purposes of this section. "chief of police" means the chief of the County of Hawaii police department or the authorized designee thereof. (b) There is established within the County of Hawaii police department and under the supervision of the chief of police. a grogram to utilize volunteers to assist in the enforcement of county and state disabled parking laws. ~o) The chief of police is authorized to commission volunteers as special disabled parking enforcement officers to issue citations on public and private property t~ersons violafin cg ounty and state disabled parking laws. ~d,) The chief of police shall: X1,2 Establish minimum qualifications for persons wishing to volunteer their services to become special disabled parking enforcement off cers and application procedures for volunteers: u Provide a required training.proeram for volunteers which shall includes but not be limited to: ~i) Knowledge of county and state disabled parkin laws: ii Identi ping violators and issuing citations: iii Use of communication and other necessary eaui ment: iv Procedures to follow in the event of confrontations with susroected violators: and Lv,2 Providing testimony in court to enforce citations: j~ Grant commissions to volunteers who have successfizll,~completed the trainingprogram. and who are qualified as determined by the chief of police. to become special disabled parking officers: and Provide for supervision and monitoring of the special disabled parking enforcement officers while such officers are on duty. Le,~ Each special disabled parking enforcement officers shall a erg a to: Volunteer a minimum number of hours per week. as determined by the chief of roolice: and Serve at locations designated by the chief of police. fLl Each special disabled parking enforcement officer who is assigned duties under this program shall receive: Mileage reimbursement at the current county rate to travel to and from the officer's place of assignment: and All other benefits for which volunteers qualify under the laws of the County of Hawaii. ~ The chief of police may refuse to commission or may revoke the commission of any volunteer whose qualifications or roerformance is found to be unacceptable to the chief. -2- The chief ofpolice shall adopt rules to implement this program.,, SECTION 3. New material is underscored. In printing this ordinance, the underscoring need not be included. SECTION 4. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are said to be severable.
