COUNTY OF HAWAII - TERRITORY OF HAWAII
RESOLUTION NO.
1~-
WHEREAS, under the provisions of Chapters 3 and 4,
Revised Laws of Hawaii-1955, the personnel director and
the civil service commission of the County of Hawaii
are empowered to reclassify the positions of the county
employees; and
WHEREAS, in March, 1958, the department of civil
service advised the board of supervisors of the County
of Hawaii that the reclassification (repricing) program
of county employees had been completed; and
WHEREAS, under the provisions of Act 170, Session
Laws of Hawaii 1957, the salaries of the first deputy
or first assistant to a department head.cannot exceed
a sum equal to 90% of the salary of the department head;
and
WHEREAS, under the reclassification (repricing)
actions of the department of civil service, the salaries
of certain subordinate employees are fixed at a sum
larger than the s6.lary of the first deputy or first
assistant and in some instances even larger than.-the
salary of the department head (when increments are taken
into consideration) although their duties and responsibi-
lities are far less than those of their superiors; and
WHEREAS, the board of supervisors took the matter
with the attorney generalts office and was advised by
said office that the actions of the department of civil
service in assigning to subordinate employees salaries

larger than that of his superior is not unlawful but
merely an exercise of poor administrative judgment; and
WHEREAS, the board of supervisors is not authorized
by law to rectify the inequities in salaries brought
about by the actions of the department of civil service;
and
WHEREAS, Act 141, Session Laws of Hawaii 1957,
mandates the County of Hawaii to pay repriced salaries.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF
SUPERVISORS in and for the County of Hawaii that this
Board will go on record to effectuate the payment of
repriced salaries to county employees in compliance with
the mandate of the law but the effectuation of same shall
be under protest because of inequities in the salaries
of certain employees.
BE IT FURTHER RESOLVE!' that the Honorable Members
of the 30th Legislature be and they are hereby respectfully
requested to exercise the good powers of their offices-
to rectify the inequiti'e's in salaries brought about by
the actions of the department of-civil service.
BE IT FURTHER RESOLVED that the-county clerk be and
he is hereby instructed and directed to. forward copies
of this resolution to the Members of the 30th Legislature
when that body convenes in 1959, the Governor of the
Territory of Hawaii, the Civil Service Commissions of
the Territory of Hawaii, City and County of Honolulu,
Kauai, Maui and Hawaii.
