Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Finance, to which was referred Resolution No. 20-99, reports as follows: Resolution No. 20-99, transmitted jointly with Resolution Nos. 19-99 and 21-99, by Finance Director Harry Takahashi, via Communication No. 69, dated December 23, 1998, authorizes the Office of the Mayor to enter into an agreement with the State Department of Transportation for a preliminary breath testing device grant. The State Department of Transportation, through funds derived from grants provided by the federal government, has authorized funding for the Hawaii County Police Deparhnent to purchase eight (8) preliminary breath testing devices. These devices will allow officers to do preliminary tests on suspected DUI/drug persons at the scene. By testing persons at the scene, only those with positive results will be transported to the police station and charged. Pursuant to Section 46-7, Hawaii Revised Statutes, county departments must obtain the consent of the council to enter into agreement with the federal or state governments respecting action to be taken pursuant to any of the powers granted by law to furnish, expend and receive any funds or other assistance in connection with projects being or to be undertaken pursuant to those powers. The Mayor of the County of Hawaii is authorized to sign the above referenced agreement and any related documents on behalf of the Office of the Mayor and the County of Hawaii pursuant to the Hawaii County Charter. Your Committee on Finance is in accord with the purpose and intent of Resolution No. 20-99 and recommends its adoption.
