Although the construction of this project will be 100% funded by Federal ARRA funds, there are various work items, primarily utility lines and other related improvements that only benefit adjacent properties. These improvements do not qualify for ARRA funds and are referred to as non- participating work. Adjacent property owners that will benefit by the non-participating work include La'i'opua 2020, the Department of Hawaiian Home Lands, Queen Lili'uokalani Trust, and Forest City. The property owners have agreed, through a Memorandum of Agreement, to pay for their share of non-participating work. Due to the urgency of this project, the Department of Public Works humbly request a waiver from the Finance Committee and to have this bill heard at the next Council meeting scheduled for January 22, 2010. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED): Although the construction of this project will be 100% funded by Federal ARRA funds, there are various work items, primarily utility lines and other related improvements that only benefit adjacent properties. These improvements do not qualify for ARRA funds and are referred to as non-participating work. Adjacent property owners that will benefit by the non-participating work include La'lopua 2020, DHHL, Queen Liliuokalani Trust and Forest City. The property owners have agreed, through an MOA, to pay for their share of non-participating work. For contracting purposes, we are including all non-partucipating work items. However, should a property owner fail to provide payment, we will deduct their work from the contract through a change order. We are requesting to waive hearing this Bill at the Finance Committee (none left in Janurary, 2010) and proceed directly to Council on January 2,2, 201Q as the project is urgent. In reviewing this matter, timely approval is crucial. It is therefore advantageous that approval is granted and the matter be placed onto the next Council agenda for review. However, in the event this request is denied, for whatever reason, I understand the matter shall be referred to the Finance Committee for placement on its future agenda.
