Your Committee on Public Safety and Parks and Recreation, to which was referred Bill No. 181, reports
as follows:
Bill No. 181, transmitted by Council Member Brenda J. Ford, via Communication No. 638, dated
December 2, 2009, amending Chapter 14, Article 1, of the Hawaii County Code 1983 (2005 Edition), as
amended, relating to consumption of intoxicating liquors at parks, by removing Kahalu`u Beach Park,
Magic Sands Beach Park, and Pdhoehoe Beach Park from Section 14-2.2, (a) (2) North/South Kona list of
! areas allowing intoxicating liquors between the hours of 10:00 a.m. and 10:00 p.m., and adds them to
Section 14-2 (a) (2), areas requiring permits for intoxicating liquors between the hours of 10:00 a.m. and
10:00 P.M.
~I Hawal I County Prosecuting Attorney Jay Kimura expressed his appreciation and support for this
measure. Mr. Kimura's department has had to address problems such as fights, harassment, disorderly
j conduct, etc.; however, driving under the influence is of greatest concern.
Ocean Safety Captain Christopher Stelfox came and testified in support of this measure based upon the
numerous incidents his ocean safety officers have encountered at Kahalu`u Beach Park, Magic Sands
Beach Park, and Pdhoehoe Beach Park.
Mr. Wayne Braden testified on this measure and stated that when people are out and about drinking, no
one thinks about delegating a designated driver. Mr. Braden is in full support of this measure due to the
loss of his daughter in an alcohol related vehicle accident.

Your Committee on Public Safety and Parks and Recreation is in accord with the purpose and intent of
Bill No. 181, and recommends it pass first reading.
