Your Committee on Finance, to which was referred Resolution No. 104-99, reports as follows:
Resolution No. 104-99, transmitted by Acting Mayor William Davis, via Communication
No. 337, dated June 16, 1999, authorizes the negotiation of a lease of a portion of the former JC
Penney site, being a portion of the Kaiko'o Mall situate at Waiakea, South Hilo, Hawaii Tax Map
Key: 3`d/2-2-15:33.
Pursuant to Resolution No. 266-96 the Corporation Counsel was authorized and empowered to
acquire by eminent domain the former JC Penney Site. The Administration has since pursued
the leasing of a portion of the site with the State of Hawaii and others. The Judiciary, for its
Family Court of the Third Circuit and for certain offices of the District Court of the Third
Circuit, has submitted a proposal to lease a portion of said site.
Pursuant to Section 2-120, Hawaii County Code, the council may, by resolution approved by a
majority of its members, direct the finance director to negotiate the disposition of real property
by, among others, leasing it to governments, government agencies, nonprofit organizations, or
affordable housing developers at such rentals and on such terms and conditions as deemed
proper.
Some Members of Your Committee questioned the County's cost to renovate the building prior
to its rental, and long-term liabilities, if any, to the County.
Your Committee on Finance is in accord with the purpose and intent of Resolution No. 104-99
and recommends its adoption.
