Your Committee on Finance, to which was referred Resolution No. 106-99, reports as follows:
Resolution No. 106-99, transmitted by Finance Director Harry Takahashi, via Communication
No. 340, dated June 10, 1999, authorizes the transfer of real property located at the intersection
of Kuakini Highway and Kamehameha III Road from the County of Hawaii to the State of
Hawaii.
The State of Hawaii and the County of Hawaii wish to reconfigure the Kuakini Highway right-
of-way at Kamehameha III Road situate at TMK 7-8-010:02 to properly conform to property
boundaries with the State's and County's jurisdictions over proposed intersection improvements
by Kamehameha Investment Corporation. In order to effectuate this purpose, a transfer of land
from the County to the State is required.
Pursuant to Section 2-120(a)(1), Hawaii County Code, the council may, by resolution approved
by a majority of its members, direct the finance director to negotiate the disposition of real
property by, among others, selling it in fee simple at such price and on such terms and conditions
deemed proper to governments and governmental agencies authorized to hold lands in fee
simple.
Your Committee on Finance is in accord with the purpose and intent of Resolution No. 106-99
and recommends its adoption.
