Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Finance, to which was referred Resolution No. 113-99, reports as follows: Resolution No. 1 13-99, transmitted by Mayor Stephen K. Yamashiro, via Communication No. 358, dated June 30, 1999, presents a partial, reformulated plan of disposition for the former Hamakua Sugar Company, Inc., lands now under County ownership. Originally, this resolution proposed to provide the Finance Director the authority to dispose of certain former Hamakua Sugar Company, Inc. lands now under County ownership and such other County owned lands which maybe available by land exchange and Fee simple sale. However, an amendment was made to exclude the Henry Street property situate at Lanihau 1~`, North Kona, Hawaii, TMK: 7-5-04:63 which may have been received by the County as a result of impact fees. The resolution further provides that should the parties fail to agree to the proposed land exchange and/or there are no qualified applicants or bidders for the proposed sale in fee simple, the Finance Director is authorized to dispose of the listed properties (Exhibits A-C) utilizing any manner consistent with the Hawaii County Code. Pursuant to Section 2-111, Hawaii County Code, the council may, by resolution, as approved by a majority of its members, direct the finance director to dispose of real property in fee simple by lease, license, or pennit. Further, Section 2-115, Hawaii County Code, provides that no exchange of real property for private property shall be made except for public purposes, and the real property exchanged shall be of substantially equal value to that of private land. In any exchange, the fair market value of the private land and the County-owned land shall be separately determined by a disinterested qualified appraiser or appraisers and the cost thereof shall be borne equally between owner and the County. In addition to the previous amendment, Your Committee voted to include a provision that required the administration to submit a report of completed negotiations to the Council. The Council will then have sixty days to disapprove the negotiated land exchange; otherwise, the report will be automatically approved.
