RESOLUTION NO. 267 98
RESOLUTION PRESENTING A PLAN OF DISPOSITION FOR THE FORMER HAMAKUA
SUGAR COMPANY, INC. LANDS NOW;UNDER COVNTYOWNERSHIP.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HA WAIl.
WHEREAS, in 1994, the Council of the County of Hawaii agreed to accept
approximately 4,400 acres of land by Commissioner's Quitclaim Deed as a settlement for
retroactive real property taxes among Western Farm Credit Bank, the County of Hawaii and
Hamakua Sugar Company, Inc.; and
WHEREAS, the settlement amount and the annual tax revenues lost as a result of the
private to public ownership conversion have shifted the tax burden to other lands during this
period of public ownership; and
WHEREAS, the Council of the County.ofHawaii, by Resolution No. 196-97 (Draft 3),
adopted on January 16, 1998, requested that the Mayor develop a disposition plan for the former
Hamakua Sugar Company, Inc. lands now under County ownership; and'
WHEREAS, the Council of the County of Hawaii requested that the completed
disposition plan be forwarded to the Council of the County of Hawaii by resolution no later than
May 1, 1998, for its review and approval; and

WHEREAS, the Administration proposes to dispose of the fonner Hamakua Sugar
Company, Inc. lands now under County ownershipbya land exchange, on a value for value
basis, for private property which are required for certain County projects; and
WHEREAS, the acquisition of the private lands will allow the County of Hawaii to
address the need for the improvement and expansion of various County facilities around the
island; and
WHEREAS, placing the fonner Hamakua Sugar Company, Inc. lands now under County
ownership into private ownership will return said lands to the tax rolls and make said lands
available for further agricultural development
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, through its authority under Section 2-111, Hawaii County Code, that it approves of
and directs the Finance director or his authorized representative to proceed with the plan of
disposition by land exchange, on a value for value basis, of so much as may be necessary of the
fonner Hamakua Sugar Company, Inc. lands now under County ownership which are delineated
on the list labeled Exhibit "A" for so much as may be necessary of those certain properties under
private ownership which are delineated onthe list labeled Exhibit "B" or for other lands as they
may become available.

The County of Hawaii proposes to exchange various parcels of
land on the island of Hawaii with private landowners, on a
value for value basis.
The County-owned lands under consideration are in the district
of Hamakua and were acquired by Comtnissioner's Quitclaim Deed
as a settlement among Western Farm Credit Bank, the County of
Hawaii and Hamakua Sugar Company, Inc., through its trustee.

The County of Hawaii proposes to acquire one or more parcels
for the expansion of the Hoolulu Park Complex (Hilo Bay Park
and Recreation Complex). The above-mentioned parcels are in
close proximity to the regional complex and the proposed
acquisition will increase the recreational opportunities for
our residents. The proposed acquisition and park development
are part of the Administration's long-term vision for the
entire bayfront area and Waiakea Peninsula.
The County of Hawaii proposes to acquire 2.00 acres, more or
less, of the former Keauhou Gardens parcel as an addition to
the Kahaluu Beach Park. The proposed addition, which is paved,
will be used as additional parking for ~he park.

Currently, beach park users have resorted to on-street parking
once 'the existing parking ,area is full. Safety is a concern
since Alii Drive is a narrow, heavily utilized thoroughfare.
The area proposed for acquisition is t,he northern, (Kailua)
Alii Drive side of the Gardens. 'This area is zoned V-4 by the
Zoning Ordinance and classified as pitt 7 by the Real Property
Tax Office.
As part of the negotiations, there should be a discussion on
'the transfer'of theV-4 density of the portion being acquired
to other portions of th~ privately owned lands. This transfe,r
of density ~ill effectively render the p~oposed acquisition
, area, as open space. Public parks are permitted uses on open
zoned ,property.
Honolii Beach Park

The County of Hawaii proposes to acquire that certain parcel of
land currently leased from ,the private landowners for the
Honolii Beach Park. 'The Admin,istration would like to do
certain improvements to the park, such as additional parking,
etc. However, the Administration does not feel that the
expenditure of CIP funds on leased lands is a 'prudent
investment of the County's limited resources.
The topography, soil condition, etc., of the parcel severely
limits the usage. The Administration believes that the site
should be valued as a single houselot parcel.

The County of Hawaii proposes to acquire the 6.64 acre parcel
as an addition to the AhalanuiPark.Located on the private
property is a large pond or a series of ponds. The pond water
from the subject parcel appears tO,flow .into the pond located
within the current park. The acquisition will allow the'County
.to clean the 6.64 Acsite, remove overhanging vegetation,
provide necessary maintenance, etc., to reduce .the animal and'
rodent popUlation, hopefully, reducing the coliform count in
the current County pond.

Any development on the conservation-zoned private parcel would
require a number of permit approvals. These approvals include,
but are not limited to, a CDUpermit, an SMA permit, the
preparation of an EA orEIS, a shoreline certification, Section
6-E approval, and a Corps permit, together with the necessary
DoH permits to work in the ponds/wetlands.
