JAN 2 9 2010 Mr. Rodney Oshiro Deputy County Clerk County of Hawai'i 25 Aupuni Street Hilo, HI 96720 Dear Mr. Oshiro: O rJ T En Administrator Babbitt has asked me to respond to your January 6 letter about obtaining Federal funding for infrastructure improvements for the county of Hawai'i. We have reviewed County Resolution 289 -09 and Mayor William Kenoi's December 28, 2009 letter seeking Federal funding for the Hawai'i County's infrastructure projects under the American Recovery and Reinvestment Act of 2009 (ARRA). The projects listed in both documents address the elimination of Large Capacity Cesspools (LCC) and construction of wastewater treatment infrastructure to meet compliance with the Federal LCC ban. The Federal Aviation Administration administers Airport Improvement Program (AIP) and ARRA funds for eligible airport development. In accordance with paragraph 515 of FAA Order 5100.38C, Airport Improvement Program Handbook, only dedicated airport wastewater treatment facilities are eligible for AIP funding. Any projects to be funded under ARRA must also meet AIP eligibility requirements. Therefore, the Kealakehe Effluent Reuse -Mauka Project is not eligible for AIP or ARRA funding. The Kealakehe Effluent Reuse -Mauka Project refers to the possible creation of wetlands that may result in attracting wildlife away from the nearby Kona International at Keahole Airport. FAA Advisory Circular 150/5200 -33B, Hazardous Wildlife Attractants On or Near Airports, discusses the establishment of wetlands near airports.
