A R.ESOLUTION REQUESTING THE MAYORTO NEGOTIATE WITH SOBA Y
HAW AI'I, INC. FOR ACQUISITION OF CERTAIN BEACHFRONTPROPERTY AT
WAI'AHABAY, NORTH KONA, HAWAI'I; DESIGNATED AS TMK: (3)7-5-018:020
WHEREAS, SoBay Hawai'i,'Inc. js the owner ofthebeachfront property at Wai'aha
Bay, North Kona, designated as TMK:(3)7.;5-018:020, and is'planning to develop a 2 I-unit
condominium consisting of 4-stories and an underground parking garage thereon; and
WHEREAS, this property and the adjoining public lands are rich in natufalbeauty' '
and resources and contain one of the few white, sand beaches in Kona; and
WHEREAS, these lands and Wai'ahaBay itself, alsolmown as Honl's, are used daily
by many residents and visitors alike for traditional and,customary activities such as surfing,
gathering, fishing, and recreation; and
WHEREAS, SoBay Hawai'iproposes to.rebuild and/or repair a seawall located on
the beach, which action may alter the natural shoreline processes and contribute to further
shoreline hardening and beach loss; arid
WHEREAS, in accordance with 'Section 4(F) of the Hawai'i County General Plan, the
, '
County shall protect, preserve ~nd enhance the quality of areas endowed with natural beauty,
including the quality of coastal scenic resources;, and
WHEREAS, Section 4( G) of this plan establishes a County policy that the shoreline
ofHawai'i shall be maintained for recreational, educational, and/or scientific uses in a,
manner that 'is protective of resources and of maximum benefit to the general public; and
WHEREAS, Section 4(K) of this plan also mandates thatthe County adopt art ,
ongoing program of identification, designation and acquisition of areas with recreational
resources, such as land with sandy beaches and other prime areas'for shoreline recreation;
and' '
~EREAS, many island residents have expressed a strong desire to protect this
, beach and perpetuate the traditional and customary activities conducted in conjunction with
it; and

WHEREAS, the Council recognizes that both public and private ownership rights
must be considered and respected in any acquisition; and .'

WHEREAS, the Councihvlshes todemonstrate its good faith and further promote a
positive and fair outcome for the general public and property owner alike; and
WHEREAS, the Council finds that it' is in the best interests of the County to acquire
the shoreline parcel described herein, and that such acquisition will be consistent with the
Hawai'i County General Plan and Code; and.
WHEREAS, the Council finds that time is of the essence in this matter.
. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
, OF HAW AI'I that it requests the Mayor to negotiate with SoBay Hawai'i, Inc. to aquire the
beachfront parcel at Wai'aha, North Kona, Hawai'i, designated as TMK: (3)7-5-018:020 for
public purposes.
BE IT FURTHER RESOLVED thatthe negotiations take into consideration any and
all possibilities and/or combination oflandexchange, transfer of development rights, and/or
other means of acquisition that may be available under the Hawai' i County Code.
BE IT FURTHER RESOLVED that the Clerk ofthe Cou~ty of HawaFi transmit
copies of this resolution to the Honorable Mayor Stephen K. Yamashiro, Director of Finance
Harry Takahashi, Real Property Tax Administrator Gary Kiyota, and Kazuichiro Furuzawa,
President of So Bay Hawai'i, Inc.
