<br />,.. ~ <br /> <br />'. <br /> <br />. <br /> <br />, COUNTY OF: HAiti <br /> <br /> <br />.' ,,"-. <br /> <br />S1"ATEOFHAWAII <br /> <br />RESOLUTION"NO. z2'gS 9~8> <br /> <br />, " <br /> <br />RESOLUTION AUTHORIZING THE ABANDONMENT AND QUITCLAIM OFA SEWER <br />EASEMENT ~MNANTTO BRIAN ANDERSON, TAX MAP KEY (3)7-5-09:025. <br /> <br />" <br /> <br />} ... <br />BE ITRESOL VED BY THE COUNCIL OF 1'H.E COUNTY OF HAWAII. <br /> <br />WHEREAS, the County of Hawaii owns an abandoned ten-foot wide sewer easement <br /> <br />across Tax Map Key No. 0)7-5-09:025, which bisects the property and encumbers atotal of <br /> <br />, <br /> <br />2,660 square feet, acquired by the County of Hawaii in 1963 for the amount of$2,325.00, as <br /> <br />shown on attached Exhibits" A" and ,IIB";and " <br /> <br />WHEREAS, by letter dated Decemb,er 6, 1996,attached as EXhibit "C, II Wastewater <br /> <br />, " <br /> <br />Division Chief Peter Boucher statedthattheCounty of Hawaii had no objection to the <br /> <br />abandonment of the sewerline and relinquishing any rights to the easement; and <br /> <br />, WHEREAS, since the sewer line easement has been abandoned and no longer serves any <br /> <br />purpose for the County of Hawaii, there is no need to continue to maintain the easement; and <br /> <br />WHEREAS, the release of the easement is vital to unencumbering the property of Brian <br /> <br />Anderson; and <br /> <br />WHEREAS, all easements, once established, continue until vacated, closed, abandoned <br /> <br />or discontinued by resolution of the Council; and <br />WHEREAS, an appraisal done for the disposal of the' easement has estimated the, fair <br />market value at $8~380,OO; .. <br />WHEREAS" the Council, , pl,lfsuant to Sectio~2..; 118, Hawaii County' Code; is, authorized <br /> <br /> <br /> <br />, - ,-. <br />.
