EASEMENT ~MNANTTO BRIAN ANDERSON, TAX MAP KEY (3)7-5-09:025.

BE ITRESOL VED BY THE COUNCIL OF 1'H.E COUNTY OF HAWAII.
WHEREAS, the County of Hawaii owns an abandoned ten-foot wide sewer easement
across Tax Map Key No. 0)7-5-09:025, which bisects the property and encumbers atotal of
,
2,660 square feet, acquired by the County of Hawaii in 1963 for the amount of$2,325.00, as
shown on attached Exhibits" A" and ,IIB";and "
WHEREAS, by letter dated Decemb,er 6, 1996,attached as EXhibit "C, II Wastewater
, "
Division Chief Peter Boucher statedthattheCounty of Hawaii had no objection to the
abandonment of the sewerline and relinquishing any rights to the easement; and
, WHEREAS, since the sewer line easement has been abandoned and no longer serves any
purpose for the County of Hawaii, there is no need to continue to maintain the easement; and
WHEREAS, the release of the easement is vital to unencumbering the property of Brian
Anderson; and
WHEREAS, all easements, once established, continue until vacated, closed, abandoned
or discontinued by resolution of the Council; and
WHEREAS, an appraisal done for the disposal of the' easement has estimated the, fair
market value at $8~380,OO; ..
WHEREAS" the Council, , pl,lfsuant to Sectio~2..; 118, Hawaii County' Code; is, authorized
, - ,-.

to dispose of any rtmmani by offering it first to an abutting oWner; and

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAll that the sewer easement remnant on Tax Map Key (3)7-5-09:025 is hereby abandoned
and discontinued as a County sewer easement and is hereby quitclaimed to Brian Anderson for
a:\wastewater'hardrock.res

. BE IT FURTHER RESOLVED thatc6pies of this resolution be sent to the Finance
Director and Chief Engineer to dispose of this easement.
