(;2:,8698) <br /> <br />RESOLUTION AUTHORIZING THE ABANDONMENT AND QUITCLAIM OF <br />REMNANTS AT PUUANAHULU HOMESTEADS, NORTH KONA, HAWAII, TO <br />THE BIG ISLAND COUNTRY CLUB ESTATES LIMITED PARTNERSHIP, TAX <br />MAP KEY (3)7-1-05: PAPER ROADS. <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br /> <br />WHEREAS, the State of Hawaii, Department of Land and Natural Resources, had <br />previously reached an agreement with the Big Island Country Club Estates Limited Partnership <br />for the transfer of paper road remnants as identified on the map attached as Exhibit II A, II which <br />have a land area of approximately 6.665 acres, and was appraised at a value of $34,500.00; and <br /> <br />WHEREAS, these road remnants are part of the ongoing dispute over these roads in <br />limbo between the State and County; and <br /> <br />WHEREAS, since the County has assumed greater responsibility with respect to these <br />roads in limbo, the County and State have both agreed thatthe County should be the body to <br />transfer these roads to the Big Island Country Club Estates Limited Partnership, and that as such <br />should receive the proceeds from the transfer from these road remnants; and <br /> <br />WHEREAS, these roads are paper roads traversing through the Big Island'Country Club <br />Estates Limited Partnership's property which do not actually appear on the ground; and <br /> <br />WHEREAS, an appraisal was done of the property in 1992 which established a fair <br />market value of $34,500.00; and <br /> <br />I <br />I <br />I <br /> <br />WHEREAS, in reviewing the values of properties within the area since 1992, our real <br />property tax division has indicated that values have dropped and therefore it would not be in the <br />best interest of the County to askfor a new appraisal; and <br /> <br />WHEREAS, it would be in the best interest of the County and the Big Island Country <br />Club Estates Limited Partnership that the paper roads be abandoned and quitclaimed to the Big <br />Island Country Club Estates Limited Partnership; and <br /> <br />WHEREAS, upon quitclaim of the property by the County, the State of Hawaii, <br />Department of Land and Natural Resources, win transfer to the County, the sum of $34,500.00 <br />held by the Department of Land and Natural Resources, from Big Island Country Club Estates <br />Limited Partnership; and <br /> <br />-- -------~-----------_._-------~--- <br /> <br />" <br /> <br />.... <br />~, <br />
