(;2:,8698) RESOLUTION AUTHORIZING THE ABANDONMENT AND QUITCLAIM OF REMNANTS AT PUUANAHULU HOMESTEADS, NORTH KONA, HAWAII, TO THE BIG ISLAND COUNTRY CLUB ESTATES LIMITED PARTNERSHIP, TAX MAP KEY (3)7-1-05: PAPER ROADS. BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII: WHEREAS, the State of Hawaii, Department of Land and Natural Resources, had previously reached an agreement with the Big Island Country Club Estates Limited Partnership for the transfer of paper road remnants as identified on the map attached as Exhibit II A, II which have a land area of approximately 6.665 acres, and was appraised at a value of $34,500.00; and WHEREAS, these road remnants are part of the ongoing dispute over these roads in limbo between the State and County; and WHEREAS, since the County has assumed greater responsibility with respect to these roads in limbo, the County and State have both agreed thatthe County should be the body to transfer these roads to the Big Island Country Club Estates Limited Partnership, and that as such should receive the proceeds from the transfer from these road remnants; and WHEREAS, these roads are paper roads traversing through the Big Island'Country Club Estates Limited Partnership's property which do not actually appear on the ground; and WHEREAS, an appraisal was done of the property in 1992 which established a fair market value of $34,500.00; and I I I WHEREAS, in reviewing the values of properties within the area since 1992, our real property tax division has indicated that values have dropped and therefore it would not be in the best interest of the County to askfor a new appraisal; and WHEREAS, it would be in the best interest of the County and the Big Island Country Club Estates Limited Partnership that the paper roads be abandoned and quitclaimed to the Big Island Country Club Estates Limited Partnership; and WHEREAS, upon quitclaim of the property by the County, the State of Hawaii, Department of Land and Natural Resources, win transfer to the County, the sum of $34,500.00 held by the Department of Land and Natural Resources, from Big Island Country Club Estates Limited Partnership; and -- -------~-----------_._-------~--- " .... ~, . . :1 WHEREAS, sections 2-111 and 2-118 of the Hawaii County Code authorizes the disposal of road remnants by offer of sale to the abutting owner; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the road remnants as set forth on Exhibit" A" and described as road remnant parcels at Puuanahulu Homesteads, North Kona, Hawaii, Tax Map Key (3)7-1-05, consisting of approximately 6.665 acres, are hereby abandoned, discontinued and quitclaimed to the Big Island Country Club Estates Limited Partnership. . . BE IT FURTHER RESOLVED that the County Clerk transmit a copy of this resolution to the Chief Engineer and Director of Finance.
