297.98
RESOLUTION RELATING TO THE EXPANSION OF THE DESIGNATED HAMAKUA
. ENTERPRISE ZONE.
WHEREAS, the encouragement of beneficial economic development is a high priority for the
County of Hawaii; and .
WHEREAS, Chapter 209E, Hawaii Revised Statutes, which became law as Act 78, Session Laws
of Hawaii, 1986, authorizes the establishment of enterprise zones, to p:ovide incentives to "qualified
businesses" for investment and job creation in certain designated areas in the State; and
WHEREAS, Chapter 209E, HaWilii Revised Statutes, requires that in order for an area to be
designated as an "enterprise zone", the a(fectt~dcounty must make an ap!llication to the Department of
Business, Economic Development and Tourism of the State of Hawaii; and
WHEREAS, Chapter 31, Hawaii County Code, which became law with the approval of
Ordinance 94-8 by Mayor Stephen K. Yamashiro on January 26, 1994, the County of Hawaii established
procedures and criteria for "nomination, . designation, amendment, provIsion. of County incentives, and
other requirements for enterprise zones"; and. .
WHEREAS, Section 31-3, Hawaii County Code, authorizes the M":lyor or Council to nominate an
area to be designated as an enterprise zone, provided that all nominations shall be approved by the
Council by resolution and the nominated area must:
a) be located with one or'more contiguous United States census tracts; and
. .

b) have twenty-five percent or more of its population with ;pcomes below eighty percent of
the median family income of the County or;
c) have an unemployment rate in the area of at least one and a half times the average
unemployment rate for the State; and
WHEREAS, in nominating an area for designation a~ an enterprise zone,
the Mayor and Council are required to consider the economic conditions of the area, the potential benefits
which may accrue to the County from business and industrial developme.;lt in the area and the need and
potential for job creation in the area; and

WHEREAS, the Hamakua Enterprise Zone, which was propos:;d by Resolution 94-275, was
approved by the State of Hawaii on October 17, 1994; and' .
WHEREAS; the Council, hasrevie~~d the applicable criteria a; ld has' considered the existing
conditions in the areas directly adjacent and contiguous to the present Ha::::lktia Enterprise Zone.
. NOW, THEREFORE, BE IT .RESOL VED BY THE COUNCIL OF THE COUNTY OF
HA WAIl, that after due and diligent consideration !If the applicablesta~(i;rds and the existing conditions
in' the area directly adjacent and contiguous to. the present' Hamaku~ Enterprise Zorie, it makes the
following findings:

a) that based on the Labor Force Data by Census Tract, May, 1998 (preliminary), the areas
contained in United States census tract 219.00 Honokaa-Kukuihaele and 221.00 North
Hilo, have an average unemployment rate of 10;34 percent, which is at least one and one-
half times the unemployment rate for the State of Hawaii; and
. .
b) there would be great potential benefits which may accrue to the County from business
and industrial development in the area and there isa need and potential for job creation in
the area; and"
BE IT FURTHER RESOLVED that pursuant to Chapter 209E, Hawaii Revised Statutes, and.
Chapter 31, Hawaii County Code, that the County of Hawaii make an application to the Department. of
Business, Economic Development and Tourism of the State of Hawaii to expand the present Hamakua
Enterprise Zone, which was approved by the State of Hawaii on October 17, 1994, to include the portion of
census tracts 219.00 and 221.00, as described in the proposed new boundaries which is attached to this
resolution as Exhibit "A" and as shown on the maps attached to this resolution as Exhibit "B", both exhibits
being incorporated into this resolution by reference; .
BE IT FURTHER RESOLVED, that the Clerk of the County of Hawaii transmit certified
copies of this resolution to the Mayor of the County of Hawaii, the Director of the Department of Business,
Economic Development and Tourism, and to the Governor of the State of Hawaii. .

HAMAKUA ENTERPRISE ZONE BOUNDARIES
Beginning at the point where [~aauilo Gulch] Kaawalii Stream
intersects with the Pacific Ocean and heading southwesterly
along said [gulch] stream across Highway 19 . to the norther.n
boundary of the [Hamakual HiloForest Reserve [(HFR)];. then
[westerlyl.northerlY and northwest alona said Hilo Forest
.Reserve boundary to the northwest corner of the Hilo Forest
Reserve~Fromthis point to the southeast corner of the Niupea
Homesteads. northwest alona this boundary. then northerly alona
same boundary to its intersection with the Hamakua Forest
Reserve .(HFR).Then' westerly alona the' northern border of the
HFR to its intersection with Paauilo Stream: along HFR boundary
to Waipunalau Gulch, south along said gulch to the northern
boundary of HFR; westerly along said boundary to the Kalopa
Gulch; north along said'gulch to the southern boundary of HFR
(Kalopa Section); then al,ongsaid boundary to the southwestern
corner of HFR (Kalopa Section); then aproximately3625'feet in
a northwesterly direction totheHFR (Nienie Section); then
west along the northern boundary of HFR (NienieSection [to the
intersection with the Nienie Gulch; northerly along Nienie
Gulch across Highway 19] and continuina alona same line alona
