Home My WebLink AboutRES 317 Draft 01 2008-2010COUNTY OF HAWAII RESOLUTION NO. 317 10 STATE OF HAWAII RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE STATE OF HAWAII DEPARTMENT OF LABOR AND INDUSTRIAL RELATIONS, PURSUANT TO HRS 46 -7, FOR FUNDING FOR THE COUNTY OF HAWAI`I'S SENIOR TRAINING AND EMPLOYMENT PROGRAM WHEREAS, the Senior Community Service Employment Program (SCSEP) is a community service and work based training program for older workers, funded under Title V of the Older Americans Act Amendments; and WHEREAS, the federal funds are channeled to the State of Hawaii Department of Labor and Industrial Relations' Workforce Development Division that annually awards a grant to the Hawaii County Office of Aging, which then contracts out this part-time training program to the Department of Parks and Recreation Elderly Activities Division's Senior Training & Employment Program (STEP); and WHEREAS, special SCSEP federal grant funds received by the State from the U.S. Department of Labor's Appropriation Act of 2009 (Public Law 111 -117, Title VIII) are being provided to the County of Hawaii to enable STEP to continue serving the nine (9) seniors added last year under the American Recovery and Reinvestment Act of 2009 (ARRA) (Public Law 111 -05); and WHEREAS, with these special funds, the nine (9) seniors currently participating in STEP under ARRA will be allowed to remain in their "on the job" training positions until June 30, 2011, otherwise they would have been terminated on May 2010, and WHEREAS, Hawaii Revised Statutes, Section 46 -7, requires that county departments obtain the consent of the council to enter into agreements with the federal or state governments respecting action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive any funds or other assistance in connection with projects being or to be undertaken pursuant to those powers. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with section 46 -7, Hawaii Revised Statutes, that the Mayor of the County of Hawai'i is authorized to execute, on behalf of the County, an agreement and related documents with the State of Hawai'I Department of Labor and Industrial Relations (DLIR), to enable the County to receive additional funds for the Senior Training and Employment Program as noted in the DLIR's Special Funds Allocation and Planning Instructions, attached hereto and incorporated herein by reference as Exhibit "A" BE IT FURTHER RESOLVED that the County Clerk of the County of Hawaii shall transmit copies of this resolution to the Office of the Mayor, the Hawaii County Office of Aging, and the Department of Finance. BACKGROUND The U.S. Department of Labor's Appropriation Act (Public Law 111 -117, Division D) was signed into law on December 16, 2009. It included an additional appropriation of $225 million in SCSEP - funds which were to be allotted within 45 days of the law's enactment (or by January 30, 2010) to current grantees that "can effectively utilize additional funding ". In order to receive an allotment of these funds, SCSEP grantees needed to complete a Statement of Inteht by January 8, 2010 reflecting demonstrated need, capacity to expend additional funds, and sustained and satisfactory performance. DLIR submitted a Statement of Intent requesting an additional $610,000 to extend services to our ARRA participants for an additional year. The additional duration will allow ARRA participants to gain additional skills which may better equip them to enter the labor force. We are currently over - enrolled in ARRA and anticipate that our regular SCSEP program will also be fully enrolled within the next month or two. Although some subprojects anticipate they may have ARRA and/or regular funds remaining at the end of the year, others expect their ARRA funds will be running out before the year is over. With an additional $610,000, we can continue services to all ARRA participants until June 30, 2011 as well as assist subprojects who will be short of ARRA funds before the current program year is over. On January 29, 2010, DLIR was informed that we are one of the selected grantees to receive additional funding and that we will be funded at the requested level of $610,000. LaCLAIR DEPUTY DIRECTOR ELAINE YOUNG ADMINISTRATOR DLIR has been communicating with all SCSEP subproject operators regarding the possibility of receiving additional funds and inquiring whether operators were able and willing to utilize additional funding. All but one operator has indicated they are able and willing to accept additional funding. To comply with the State procurement rules, DLIR has submitted a Request for Exemption from Chapter 103F, HRS to the State Procurement Office. A Request for Infoiniation has also been prepared - soliciting expressions of interest. Our exemption request has been approved and subprojects willing and able to accept additional funding have expressed their interest in participating on this project. POLICY Participants under this Special Fund grant will be ARRA participants who need additional assistance in finding employment. These participants may be provided additional services for up to an additional year. Once the operator has expended all of their allocated ARRA funds or on July 1, 2010, whichever is earlier, ARRA participants will be transferred into the operator's regular SCSEP database in SPARQ. Additional guidance on the transfer procedures will be provided at a later date. Although the program performance of these Special Funded participants will be reported as part of the regular SCSEP grant, operators will need to track and report the expenditures for these participants separately. Grantees and operators are expected to adhere to the current statutory and regulatory requirements for SCSEP as contained in the following: • 2006 Older Americans Act (OAA) Amendments, Public Law 109 -365 • SCSEP Performance Accountability Interim Rule, 20 CFR Part 641, Subparts A and G, 72 Federal Register 36832 (June 29, 2007) • SCSEP Final Rule 20 CFR Part 642 (April 9, 2004) • Priority of Service for Covered Persons: Final Rule 20 CFR Part 1010, 73 FR 78132 (December 19, 2008); and • The American Recovery and Reinvestment Act of 2009, PL 111 -05, Division A, Title VIII. Additional policy guidance will be issued once received from USDOL. PROCEDURES Utilizing the attached Allocation of Special SCSEP Funds by County chart, operators should prepare a project narrative (proposal) and budget documents for the use of the special funds as soon as possible and submit it to the Workforce Development Division Administration Office no later than March 23, 2010.
