Your Committee on Finance, to which was referred Resolution No. 140-99, reports as follows:
Resolution No.140-99, transmitted by Council Member Dominic Yagong, via Communication
No. 436, dated September 8, 1999, authorizes the Director of Finance to negotiate the disposition
of the East Hawaii Cultural Center by leasing it to the East Hawaii Cultural Council pursuant to
Section 2-120, Hawaii County Code.
The County owns the East Hawaii Cultural Center located at 141 Kalakaua Street, Hilo,
Hawaii, identified by Tax Map Key 2-3-6:4. Currently, the East Hawaii Cultural Council
(EHCC) leases this site; however, the current lease is due to expire in November 2000.
Therefore, EHCC is desirous of obtaining another 20-yeaz lease of the said property to conduct
its programs, activities, events and classes.
Pursuant to Section 2-120, Hawaii County Code, the Council may, by resolution approved by a
majority of its members, direct the Finance Director to negotiate the disposition of real property
by leasing it to nonprofit organizations at such rentals and on such terms and conditions as
deemed proper without the notice or appraisal required in this article.
Some members of Your Committee were concerned with the need to clarify language in the lease
agreement regarding insurance and indemnification. More information was also requested from
the Department of Parks and Recreation and the Office of the Corporation Counsel.
Resolution No. 140-99 was amended to conform to other lease agreements by giving the Director
of the affected Department the sole authority to decide and resolve matters not covered in the
lease agreement. In this case the Director of the Department of Parks and Recreation will
replace the Mayor of the County of Hawaii as originally intended.
Your Committee on Finance is in accord with the purpose and intent of Resolution No. 140-99,
as amended to Draft p2,~ (and reccommends its adoption.
