'.' <br />.....j.-...;':,.. <br /> <br />RESOLUTION NO. <br /> <br />312 98 <br /> <br />RESOLUTION AUTHORIZING THE ABANDONMENT AND QUITCLAIM OF <br />ROADWAY REMNANT AT KAUMALUMALU, NORTH KONA, HAWAII, TO <br />RICHARD ADCOCK, TAX MAP KEY (3)7-7-04:049. <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br /> <br />WHEREAS, the County of Hawaii owns a 257 square foot roadway remnant on Alii <br /> <br />Drive, at Kaumalumalu, North Kona, Hawaii, Tax Map Key (3)7-7-04:049, which abuts the <br /> <br />property of Richard Adcock~ and <br /> <br />WHEREAS, adjacent roadway remnants immediately to the north and south of Richard <br /> <br />Adcock's property were conveyed to the abutting landowners by the State ofHawaii~ and <br /> <br />WHEREAS, it has been determined by the Planning Department that the existing Alii <br /> <br />Drive right-of-way is fifty (50) feet wide with no future road-widening~ and <br /> <br />WHEREAS, all roadway remnants, once established, continue until vacated, closed, <br /> <br />abandoned or discontinued by resolution of the Council; and <br /> <br />WHEREAS, Section 2-118(b), Hawaii County Code, allows the Director of Finance to <br /> <br />establish a price for remnants under 2,500 square feet~ and <br /> <br />WHEREAS, the Real Property Tax Division has assessed the roadway remnant at $7.00 <br /> <br />per square foot, for a total of$I,799.00 for 257 square feet; and <br /> <br />WHEREAS, Sections 2-111 and 2~ 118, Hawaii County Code, authorizes the disposal of <br /> <br />road remnants by offer of sale to the abutting owner; <br /> <br />~. <br /> <br />..'- ...-.. <br />
