A RESOLUTION AUTHORIZING THE MAYOR TO NEGOTIATE AND EXECUTE AN
AGREEMENT WITH HAKALAU FARMS, LTD., TO SATISFY THE AFFORDABLE
HOUSING REQUIREMENT FOR KUPULAU HEIGHTS SUBDIVISION
WHEREAS, Hakalau Farms, Ltd. ("HFL"), owns approximately
10.23 acres of land at Kupulau, South Hilo, Hawai'i, covered by
tax map key number (3) 2-4-65: 4, hereinafter referred to as the
"Property"; and
WHEREAS, on July 3, 1997, Change of Zone Ordinance 97-91
became effective and rezoned the Property; and
WHEREAS, Condition "I" of Change of Zone Ordinance 97-91
requires that the applicant be responsible to provide affordable
housing; and
WHEREAS, the 'County proposes to enter into an agreement with
HFL to satisfy Condition "I" of Change of Zone Ordinance 97-91;
and
WHEREAS, the HFL has submitted a proposal, pursuant to
. Ordinance 98-1, to sati~fy the HFL's affordable housing
condition.
NOW, THEREFORE, BE IT RESOLYED BY THE COUNCIL OF THE COUNTY
OF HAWAI'I that.the Mayor is hereby authorized to negotiate and
execute an agreement with,Ha,kalau Farms; Ltd.,' to satisfy its
affordable housing condition imposed by Change of Zone
Ordinance 97-91.

BE IT FURTHER RESOLVED that, pursuant to Section 11-4(d) of
Ordinance 98-1, the period approved by the County Housing Agency
to implement the plan to satisfy the affordable housing condition
shall be five .(5) years.
BE IT FURTHER RESOLVED that a copy of this resolution be
transmitted to the Office of the Mayor, the Planning Department,
the Office of Housing and Community Development and to Hakalau
Farms, Ltd.
