Re: Comm. No. 693 /Res. No. 298 -10
The Committee on Public Safety and Parks and Recreation, to which was referred Resolution
No. 298 -10, reports as follows:
Resolution No. 298 -10, transmitted by Council Member Brenda J. Ford, via Communication
No. 693, dated February 2, 2010, requesting the legislature of the State of Hawaii to amend
Hawaii Revised Statutes Chapter 132D, Section 17, (inconsistent county ordinances, rules) to
allow the fire chief of each respective county to restrict the use of fireworks in the event of a
public health, safety, and/or welfare situation that provides for temporary restrictions on the use
of fireworks.
Council Member Brenda J. Ford, transmitted Communication No. 693.1, dated
February 16, 2010, with proposed amendments to Resolution No. 298 -10, which reads as
follows:
Proposed amendment #1, amends the title of the resolution as shown in Ramseyer format to read:
"A RESOLUTION REQUESTING THE LEGISLATURE OF THE STATE OF
HAWAII TO AMEND HAWAII REVISED STATUTES CHAPTER 132D, SECTION 17,
(INCONSISTENT COUNTY ORDINANCES, RULES), TO ALLOW [
] EACH COUNTY TO TEMPORARILY RISTRICT THE USE
OF FIREWORKS IN THE EVENT OF A PUBLIC HEALTH, SAFETY, AND /OR
WELFARE SITUATION."
Proposed amendment #2, amends the fifth Whereas as shown in Ramseyer format to read:
"WHEREAS, smoke from the fires blanketed most of North and South Kona for several
weeks causing respiratory distress for many residents; and"
A motion to amend was made and seconded, followed by a vote by the Members in attendance.

Council Member Brenda J. Ford stated that fireworks has been a tradition world wide for many
years, and that the effects of the smoke from the three fires that occurred prior to Christmas and
continued to burn during the New Year weekend, along with the vog in addition to the smoke
from fireworks affected residents which caused respiratory distress.
Your Committee on Finance is in accord with the purpose and intent of Resolution No. 298 -10,
as amended to Draft 2, and recommends its adoption.
