AN ORDINANCE AMENDING ORDINANCE NO. 98 -50. AS AMENDED, RELATING TO
PUBLIC IMPROVEMENTS AND FINANCING THEREOF FOR THE FISCAL YEAR
JULY L 1998 TO JUNE 30, 1999.
WHEREAS, Resolution No, 192 -97 extended the additional 3.8 cents per gallon in fuel
tax revenues set by Resolution No. 397 -88 until June 30. 2008; and
WIIEREAS, it is anticipated that the increase in the county fuel tax will generate a
projected S2.5 million in highway fund revenues annually; and
WHIRI[AS. Resolution No. 192-97 provided that any and all increases in highway fund
revenues generated by the fuel tax increase shall he expended for highway fund improvements as
appropriated; and
WHEREAS, Resolution No. 192 -97 provided that expenditures of all revenues generated
by the fuel tax increase be based upon the apportionment formula developed by the Department
of Public Works; and
WHEREAS, the Department of Public Works has formulated [an expenditure plan] a
Fuel Tax Program Revenue Appropriation Plan (Increment 1) for the FY 1998 -2000 fuel tax
increase.
WHEREAS, the Council finds that there are at least 1,000 miles of roads which fall
within the auspices of Chapter 264, Section 264 -2, of the Hawaii Revised Statutes. and have
been commonly referred to as "Roads -In- Limbo," and
WHEREAS, some of the "Roads -In- Limbo" within Hawaii County need to he
maintained.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Ordinance No. 98 -50, as amended, Relating to Public Improvements
and Financing 'fhcreof for the Fiscal year July 1. 1998 to June 30. 1999, is hereby
amended by establishing the following program appropriations:

PROGRAM AMOUNT
Allotments from these program appropriations shall be made to be specific projects listed
on the attached Exhibit A.
SECTION 2. Funds for these projects shall be provided from that portion of the
Highway Fund which is designated as the Fuel Tax Increase Account No. 3104.06. and
which consists of the increase fuel tax revenues created pursuant to Resolution No. 192 -97.
SECTION 3. If any provision of this ordinance is held invalid. such invalidity
shall not affect other provisions or applications of the ordinance which can he given effect
without the invalid provision or application, and to this end, the provisions of this
ordinance are declared to be severable.
SECTION 4. This Ordinance shall take effect upon its approval.
