<br />RESOLUTION AUTHORIZING THE GRANT OF A WATER LINE EASEMENT
<br />AT KAAPOKO HOMESTEADS; $OUTH.,HILO, HAWAII ISLAND,. COUNTY
<br />AND STATE OF HAWAII, TAX MAP KEY NO. (3) 2:7-05 - TO MARTIN
<br />GANIGAN JR., AND LINDA GANIGAN, MILES K. NAGATA AND LYNNEJ.

<br />WHEREAS, Chapter 2, Article 19, Section 2-111, of the Hawaii County
<br />Code provides that the County Council may, by resolution approve~:L,by a
<br />majority of its. members, dispose of real property; and -ii
<br />
<br />WHEREAS, the County of Hawaii is the owner of that certain homestead
<br />road located at Kaapoko Homestead, South Hilo, Hawaii, Island, County and
<br />State of Hawaii as shown on the enclosed tax maps; and
<br />
<br />WHEREAS, the Department of Public Works, Engineering Division, has
<br />issued a .conditional permit to the owners to install the waterline, to serve their
<br />water needs; and
<br />
<br />WHEREAS, the owners are requesting the Counl,y of Hawaii to grant a
<br />waterline. easement, subject, however, to _ reversion . to the county upon
<br />termination or abandonment of the easement for the specific purposes for which
<br />it was granted; and
<br />
<br />WHEREAS, an independent appraiser determined that the fair market
<br />value of the waterline easement is $1,700.00 with an area of 6,081 square feet.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
<br />COUNTY OF HAWAII, in accordance with Chapter 2, Article 19, Section 2-111
<br />of the Hawaii County Code, that the County of Hawaii authorizes a grant of an
<br />easement for the installation of waterline to Martin and Linda Ganigan Jr., Miles
<br />K. and Lynne J. Nagata, Dorothy. D. _ Patao and James R.and Linda_ C.
<br />Kennedy. '
