RESOLUTION NO. 338 98
A RESOLUTION REQUESTING THE OFFICE OF THE LEGISLATIVE AUDITOR
TO CONDUCT A SPECIAL STUDY OF THE HAWAII COUNTY POLICE
DEPARTMENT'S GRANT 96-DB-13 WITH THE STATE ATTORNEY GENERAL
AND GRANT 97-39 WITH THE DRUG ENFORCEMENT ADMINISTRATION OF
THE U.S. DEPARTMENT OF JUSTICE.
WHEREAS, on March 20, 24, 25 and April 23, 1997, the County Council through its 0
Finance Committee conducted its mandatory review of all programs of the County
seeking funding for Fiscal Year 1997-98, pursuant to Section 3-16. Hawaii County
Charter and Rule 24 of the Hawaii County Council; and
WHEREAS, on June 2, 1997, the County Council adopted the Operating Budget for
Fiscal Year 1997-98 with an effective date of July 1, 1997; thereby favorably authorizing
the continuation of those programs included in the Operating Budget; and
WHEREAS, effective July 2, 1997, the County Council approved Resolution Nos. 94-97
and 116-97, both of which authorized the County of Hawaii to enter into an agreement
with the United States of America for a Statewide Marijuana Eradication Grant and a
Domestic Cannabis Eradication/Suppression Program Grant (Grant 96-DB-13 and
Grant 97-39, respectively); and . '
WHEREAS, Grant 96-DB-l3 involved the receipt of $ 108,294 from the State
Department of the Attorney General, which served as a pass-through agency for the U.S.
Department of Justice. The County, in accepting the federal funds, agreed to a match of
$36,098. The Project Period, with an extension, was from April 1, 1997 to June 30, 1998
and
WHEREAS, Grant 97-39 involved the receipt of $195,000 from the Drug Enforcement
Administration of the United States Departnlent of Justice. No County funds were
committed. The Project Period, was from January 1, 1997, to December 31, 1997; and
WHEREAS, in compliance with the Single Audit Act Amendments of 1996 and OMB
Circular A-l33, a Single Audit Repo'rtfor the Fiscal Year Ended June 30,1997, was
conducted by the County Council's independent auditor. The Single Audit Report
included Grant 96-DB-13 and Grant 97-39 in its 'Schedule of Expenditures of Federal
Awards';'and

WHEREAS, because of the testimony received by the Council at its meetings held on
Resolution Nos. 94-97 and 116-97, the Council is desirous of conducting a special study
surrounding. specific. issues relevant to the implementation of these federal grant
programs; and
WHEREAS, the Council adopted Resolution 131-97, which established a policy under
which it would implement its own Rule 24 by setting forth the manner in which it would
conduct the Council's Independent Audit, the Mandatory Program Review and any
Expanded Research and Special Studies. The Resolution also sought to bring clarity to
the utilization of its own staff and budget resources for work tasks it requested either
individually or as a body.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that it finds a special study of Grant 96-DB-13 and 97-39 is warranted after
considering the testimony received at its Committee and Council meetings. .
BE IT FURTHER RESOLVED that the scope and objectives of the special study shall be
as follows:
.1. Examine the effectiveness of each grant program by determining the
extent to which each grant program met its stated goals and objectives as
defined in Grant 96-DB-13 and 97-39.
2. Examine the expenditures of each grant program to determine whether
funds were spent in a manner consistent with the budgeted amounts stated
in the grants and whether the expenditures further the stated goals and
objectives of each grant and as authorized by the grantor.
3. Determine whether the County Police Department has complied with the
obligations of each grant.
4. Examine whether internal controls exist and are being complied with
regarding procedures used by the Police Department when confiscating
and disposing of marl juana or confiscating cash evidence as it relates to
the subject grants.
5.. Examine whether response and disposition procedures exist and are being
followed by the Police Department when handling public complaints of
aerial activities related to the subject grants.
6. Document the level of expenditures for each grant since 1994 and the level
of performance reported in each grant in order for the Council to analyze
possible grant trends.

BE IT FURTHER RESOLVED that it requests the Office of the Legislative Auditor to
investigate the above-stat~ scope and objectives and provide a report to the Council.

BE IT FURTHER RESOLVED that it requests full cooperation from the Police
Department in providing any requested documents and responses for the special study.
BE IT FINALLY RESOLVED that the Clerk of the County of Hawaii transmit copies of
this resolution to the Legislative Auditor Constance R. Kiriu, Mayor Stephen K.
Yamashiro, Police Chief Wayne Carvalho, State Attorney General Margery Bronster, and
Mr. Sidney Hayakawa, Drug Enforcement Administration Special Agent in-Charge.
