WHEREAS, HRS 36-41 provides t~at any agency may enter into a multi-year performance contract,notexc:eeding fifteen (15) years,fc)'r the purpose of under:taking or implementing energy conservation or alternate energy measures in a facility or facilities; and WHEREAS, when the County of Hawaii entered into a performance contract for an energy retrofit to the Hawaii County Building in 1997, the' annual electricity usage for that facility was reduced by 33%, saving the County of Hawaii $67,406 in electricity costs in the first year of post-retrofit operations; and WHEREAS, the County of Hawaii intends to implement a performance contract for energy efficiency retrofits to the remaining inventory of County- owned buildings as a result of the favorable experience with the performance contract for the Hawaii County Building; and WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or other obligation requiring payrnentof funds from the appropriations of a later fiscal year or more than one fiscal year be approved . by resolution. NOW, THEREFORE, BE IT RESO~VED BY THE COUNCIL OF THE COUNTY OF HAWAII: 1. That the Mayor be authorized to enter !nto a multi-year performance contract for an energy retrofit for all Hawaii County buildings. 2. That it is the intent of this Council that sufficient funds be budgeted in future fiscal years to cover the anticipated obligation of the County under the performance contract.
