Council Member RE: Proposed Amendment to Resolution 310 -10; Notifying the State Department Of Transportation about the Kohanaiki Beach Park Intersection Salcty Hazards For your consideration, please find attached a proposed amendment to Resolution 310 -10 The proposed amendment, illustrated via Ramseyer format with respect to the contents of Resolution 310 -10, reads as Ibllows (material to be added is underscored): A BE 11 P IER RESOLVED clause is added to read as follows: "I3E 11' FURTHER RESOLVED that the Mayor loin the Council in voicing this concern on the Dart of local constituents as well as visitors." WHEREAS. the Hawaii County Council adopted Resolution No. 241 -09 on October 21. 2009; and WHEREAS, Resolution No. 241 -09 included the following requests to and recommendations lbr the Hawaii State Department ofTransportation: L That all subsequent State Department of Transportation planning interface with Hawaii County planning before implementation of any facilities on Hawaii Island. 2. That Huliko'a Drive intersection remain a full - movement intersection in the design of the Queen Ka'ahumanu I lighway Phase 11 Widening. • 3. That the access to the shoreline at Kohanaiki be studied to determine whether modifications can be made to allow for a full movement intersection; and WHEREAS, to date there has been no response to those requests; and WHEREAS. the Kohanaiki beach park intersection is north of Kailua -Kona and the • majority of the park's users approach the access point from the south: and WIIEREAS. users approaching from the south are presently required to engage in dangerous maneuvers in order to gain access to the park; and WiiEREAS. these motorists consequently place themselves and their passengers, as \veI! • as other drivers and their passengers, at extreme risk: and WHEREAS, all the paving requirements to provide safe access are in place; now. • therefore. BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the State Department of Transportation be placed on notice that if this situation is not corrected, serious injuries or fatalities involving citizens of this county or our visitors may occur due to blatant disregard to accepted principles of safety. BE IT FURTHER RESOLVED that the Mayor join the Council in voicing this concern on the part of local constituents as well as visitors. BE IT FINALLY RESOLVED that the County Clerk shall forward copies of this resolution to the 1 lonorable Mayor William Kenoi, the Director of the Department of Planning. the Director of the Department of Public Works, and the Director of the Department of Transportation, State of Hawaii.
