Enclosed is a bill for an ordinance amending Chapter 19, Sections 19-100 and 19-101
of the Hawaii County Code 1983 (2005 Edlition, as amended), relating to deposits
accompanying appeals to the Real Property Tax Board of Review. This bill proposes to
increase the deposit amount from $15 to $25 and to limit refunds of that amount to
situations where the board of review accepts the taxpayer's appeal value without
compromise. Refunds would also be made in-cases where adjustments are necessary
due to clerical errors. For this fiscal year, we received 1,449 appeal forms with deposits
totaling $21,735 and we refunded approximately $9,885 in deposits. Under the
proposed deposit regulations, taxpayers would have paid an additional $14,490. The
purpose of increasing the deposit amount and limiting refunds of those deposits is two-
fold. The additional amount will better offset the cost of handling appeals and it should
also reduce the number of frivolous appeals.

Requesting amendment to Hawaii County Code, Chapter 19, Sections 19-100 and 19-101 regarding
deposits accompanying appeals to the Real Property Tax Board of Review.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
The attached bill proposes to increase the deposit amount from $15 to $25 and to limit refunds of that
amount to situations where the board of review acrepts the taxpayer's appeal value without compromise.
