RESOLUTION AUTHORIZING THE FINANCE DIRECTOR TO NEGOTIATE THE
DISPOSITION OF REAL PROPERTY BY LEASE TO OCEAN VIEW COMMUNITY
DEVELOPMENT CORPORATION, A HAWAII NONPROFIT AGENCY.
WHEREAS, The Ocean View Community Development Corporation (OVCDC), a
Hawaii nonprofit agency, seeks to develop a water source in the Ocean View Subdivision to
provide a water dispensing and emergency water source for fire and other disaster relief in the
area; and
WHEREAS, OVCDC has received funds from the State of Hawaii to commence the
exploratory drilling for this new water well site; and
WHEREAS, The County of Hawaii owns the properties adjacent to the Ocean View
Community Center, which have been identified as appropriate exploratory site for the water
wells and are identified as Tax Map Key Nos. (3) 9-2-09: 052, 053, and 054; and
WHEREAS, OVCDC seeks a long term leaSe in order that it may proceed with its
exploratory drilling at that location; and
WHEREAS, Section 2-120 of the Hawaii County Code allows the Council by resolution
to direct the Finance Director to negotiate the disposition of real property by leasing it to
nonprofit organizations at such rentals and on such terms and conditions as deemed proper.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that pursuant to Section 2-120, Hawaii County Code, the Director of Finance is hereby.

directed to negotiate the disposition ofthe County's properties identified as TMKs (3)9-2-09:052,
053 and 054 located in the Hawaiian Ocean View Estates subdivision by way of lease to the
Ocean View Community Development Corporation, a Hawaii nonprofit agency.
BE IT FURTHER RESOLVED that copies of this resolution-be sent tothe Mayor,
Finance Director andthe Ocean View Community Development Corporation.
