HAWAII COUNTY COUNCIL County of Hawai`i 25 Aupuni Street Hilo, Thwart 96720 April 7, 2010 0 Memo To: J Yoshimoto, Chair rig And Members of the Hawai`i County Council -.a • / ,,_ 3 From: Dominic Yagong, Council Member Re: Proposed Floor Amendment to Resolution No. 312 -10 = ° Attached please find proposed amendments to Resolution No. 312 -10 that adds four Whereas clauses being numbers 14, 15, 16, and 17 as follows: "WHEREAS, the Hawaii County Council recognizes that the current Kealakehe Greenwaste facility services many residents of West Hawai`i; and WHEREAS, the Hawaii County Council recognizes the concerns expressed by West Hawai`i residents that approval of this multi -year contract may reduce or eliminate the current Kealakehe facility as a green waste drop off facility for Kona Residents; and WHEREAS, the Council appreciates and see the value of continued operation at the Kealakehe facility as it will compliment the Pu'anahulu Greenwaste Collection facility; and WHEREAS, the Council would like to insure the public that the approval of this multi- year contract will not eliminate or severely reduce the hours of operation at the Kealakehe facility." To: Ref. 4aie I R 0 7 'intO RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL YEAR AND OF MORE THAN ONE FISCAL YEAR FOR A MULTI -YEAR AGREEMENT FOR FURNISHING AND IMPLEMENTING GREEN WASTE COLLECTION SITES IN WEST HAWAFI AND EAST HAWAFI FOR THE DEPARTMENT OF ENVIRONMENTAL MANAGEMENT WHEREAS, Section 10 -11 of the County Charter requires that any contract, lease or other obligation requiring payment of funds from the appropriations of a later fiscal year or more than one fiscal year be approved by resolution; and WHEREAS, the County completed construction phase for the Materials Recovery Facility infrastructure for West Hawaii at the Pu'uanahulu Landfill to include a site for green waste collection; and WHEREAS, the County has prepared a Request for Proposal (RFP) "REQUEST FOR PROPOSALS FOR FURNISHING AND IMPLEMENTING GREEN WASTE COLLECTION SITES FOR THE DEPARTMENT OF ENVIRONMENTAL MANAGEMENT "; and WHEREAS, green waste collection sites will divert organic materials from County transfer stations and landfills initially including green waste and untreated wood and in the future could include other organic waste materials like biosolids, food, paper and FOG's (Fats, Oils & Grease); and WHEREAS, Green Waste Collection Sites will provide valuable products such as mulch or compost for local consumers and businesses, reducing the need to import these products; and WHEREAS, the high equipment and operations start-up costs, estimated at $1,000,000.00, require a multi -year commitment to recoup costs and secure reasonable terms for equipment financing; and WHEREAS, the County finds it in its best interest to contract for private services of a contractor to operate green waste collection sites with a five (5) year agreement, with two (2) 12 month options to extend contracted services; and WHEREAS, the Update to the Integrated Solid Waste Management Plan identified recycling and waste diversion as major activities to help the County reach its goal to divert 50% of all solid waste that would otherwise go to a landfill, by 2008 and 80% by 2013; and Resolution 28 -03 Draft 2 was approved by Council on January 23, 2003, setting forth these goals and policies, and WHEREAS, Resolution 356 -07, A Resolution to Embrace and Adopt the Principles of Zero Waste as a Long -Term Goal for Hawaii County was approved by Council on December 19, 2007; and WHEREAS, Resolution 826 -08, A Resolution Urging the Director of the Environmental Management to Develop an Ordinance and Implement a Plan to Prohibit Food, Paper, and Compostable Organics from Hawaii County Landfills by 2012 was approved by Council on January 23, 2009; and WHEREAS, landfills have a finite amount of space. The South Hilo Landfill is projected to reach maximum capacity within a few years. The Pu'uanahulu Landfill has more available air space at this time, but it will also reach capacity at some point in the future; and WHEREAS, landfills are expensive to maintain. They must comply with strict Department of Health (DOH) requirements while in service and must be monitored for at least 30 years after they are closed. The establishment of any waste disposal facility is controversial; and WHEREAS, Organic diversion programs like green waste collection sites diverts material out of the waste stream, preserves natural resources and prolongs the life of the landfills; and WHEREAS, the Hawaii County Council recognizes that the current Kealakehe Greenwaste facility services many residents of West Hawai`i; and WHEREAS, the Hawaii County Council recognizes the concerns expressed by West Hawai`i residents that approval of this multi -year contract may reduce or`eliminate the current Kealakehe facility as a green waste drop off facility for Kona Residents; and WHEREAS, the Council appreciates and see the value of continued operation at the Kealakehe facility as it will compliment the Pu'anahulu Greenwaste Collection facility; and WHEREAS, the Council would like to insure the public that the approval of this multi- • year contract will not eliminate or severely reduce the hours of operation at the Kealakehe facility. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWATI that'in accordance with Article X, Section 10 -11 of the Hawaii County Charter, the Mayor is hereby authorized to enter into a multi -year contract for services of furnishing and implementing green waste collection sites in West Hawai'i and East Hawai'i for the Department of Environmental Management and that sufficient funds be budgeted in future fiscal years to cover the anticipated obligation of the County under the terms of the agreement. BE IT FINALLY RESOLVED that the County Clerk shall forward a copy of this resolution to the Mayor, the Director of Environmental Management and the Director of Finance.
