REPORT OF THE
COMMITTEE ON PLANNING
Your Committee on Planning, to which was referred Bill No. 184, reports as follows:
Bill No. 184, transmitted via Communication No. 652, from Mayor William P. Kenoi dated
November 30, 2009, presents a Request for a Change of Zone from Single Family Residential
7,500 square feet (RS -7.5) and Multiple - Family Residential — 1,000 square feet (RM -1) to
Multiple - Family Residential— 1,500 square feet (RM -1.5) at Kukuau 1 South Hilo, Hawai`i,
covered by tax map key: 2 -4- 025:048, 053, and 80, for parcels which total approximately 5.05
acres of land in size. The property is located mauka of Kapiolani Street and the County of
Hawai`i Police Department complex.
There was no public testimony regarding Bill 184. Margaret Masunaga, Deputy Director of the
Department of Planning appeared before your Committee. Also appearing was Amy Self, from
the Corporation Counsel.
Steven Lim, Esq. and the applicant, Giampaolo "Paul" Boschetti appeared before your
Committee. Mr. Lim informed your Committee that the project will be multi - family units.
Mr. Lim stated that at there was a possibility that the project might be for student housing, but
nothing would be finalized until after the rezoning process was complete.
Council Member Brenda Ford stated that standardized language from the Department of
Environmental Management (DEM) regarding sewers was omitted. Deputy Corporation
Counsel Amy Self informed your Committee that the language used in the conditions of rezoning
regarding sewers included concerns stated by DEM. She further stated that DEM must notify the
Planning Department if a change of language is needed. For purposes of clarification, Planning
Committee Chair Ikeda and his staff will be working with the departments to determine what, if
any, shall be considered "standard language ".
Other concerns from your Committee members included aesthetics of the drainage easement,
water commitments, community input and notification, FEMA flood plain proximity, traffic and
affordable housing.

Mr. Lim informed your Committee that the drainage easement will be aesthetically pleasing,
dependent upon the type of drainage system that will be utilized. He further informed your
Committee that the water commitments for the project were more than sufficient for the type of
residences that are planned. Mr. Lim educated your Committee members by informing them that
typical water usage for a single family dwelling is 600 units per day, whereas in a condo or
apartment situation such as this project, the water usage is generally lower, closer to 400 gallons
per day.
Mr. Lim stated that the legal requirement for notification was met, and that his office is working
closely with members of the community to mitigate their concerns, if any. He stated after
hearing concerns from an adjoining neighbor who feared he would be landlocked, the adjoining
neighbor was granted a permanent easement through the project property to reach his driveway.
Mr. Lim stated that the applicant is working with, and will abide by the determination of, the
Department of Public Works regarding the small portion of the drainage easement that is in the
FEMA floodplain. Ingress and egress from Kapiolani Street is limited to right -in, right -out only,
in order to address concerns stated by the Hawai`i County Police Department.
Mr. Lim informed your Committee that the applicant was not sure how the affordable housing
requirements would be met, but assured your Committee that the applicant will fulfill those
requirements.
There was no further discussion regarding Bill 184. Your Committee concurs with the Planning
Commission and the Planning Director's favorable recommendation for approval of the re-
zoning request.
For informational purposes, Council Member Ford voted "kanalua" twice.
Your Committee on Planning is in accord with the purpose and intent of Bill No. 184 and
recommends it pass first reading.
