SUBJECT: RESOLUTION AUTHORIZING THE EXEMPTION OF THE KALOKO
HOUSING PROJECT IN KAILUA -KONA FROM CERTAIN CODE
REQUIREMENTS AND RULES PURSUANT TO SECTION 201H -38 OF
THE HAWAII REVISED STATUTES
The Office of Housing and Community Development (OHCD)
respectfully requests your consideration of the subject items,
related to the Kaloko Housing Program (Project), for placement on
the February 3, 2010 Hawaii County Council agenda.
The attached resolution would grant approval for the exemption of
the Project from any County zoning processes and requirements,
pursuant to the affordable housing provisions of Hawaii Revised
Statutes (HRS), Section 201H -38, and in accordance with the land
use district classification provisions of HRS, Section 205 -3.1.
As time is of the essence, the OHCD looks forward to your
approval. Should you have any questions, or require further

RE: Resolution No. 294 -10 : A Resolution Authorizing the Exemption of the Kaloko
Housing Program in Kailua -Kona From Certain Code Requirements and Rules Pursuant to
Section 201h -38 of the Hawai`i Revised Statutes.
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above - referenced matter be
waived from the Planning Committee to the full Council for immediate action. In reviewing this
matter, timely approval is crucial. It is therefore advantageous that approval be granted and the
matter be placed onto the next Council agenda for review. However, in the event this request is
denied, for whatever reason, 1 understand the matter shall be referred to the Planning Committee
for placement on its future agenda.
