RESOLUTION ACCEPTING THE DONATION OF LOT 117 -A, SITUATE AT `OLA`A,
DISTRICT OF PUNA, COUNTY AND STATE OF HAWAII, IDENTIFIED AS BEING A
PORTION OF TAX MAP KEY: (3)1 -8- 005:125, FROM WILLLIAM H. FLAMMER III.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII.
WHEREAS, WILLIAM H. FLAMMER III, TRUSTEE, is the owner of Lot 117, situate at
`Ola`a, in the District of Puna, County and State of Hawai`i, identified as Tax Map
Key: (3)1 -8- 005:125; and
WHEREAS, the County of Hawaii owns and maintains North Pszyk Road; and
WHEREAS, North Pszyk Road encroaches onto lands owned by William H. Flammer III,
Trustee; and
WHEREAS, William H. Flammer III, Trustee is presently in the process of subdividing out the
encroachment (Lot 117 -A), more particularly described in Exhibit "A" and delineated on Exhibit "B"
attached hereto, and is desirous of donating said Lot 117 -A to the County of Hawai`i; and
WHEREAS, Article XIII, Section 13 -12 of the Hawaii County Charter, provides that the
Council may accept gifts, which include the donation of land on behalf of the County of Hawaii.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that in accordance with Article XIII, Section 13 -12 of the Hawaii County Charter, the
County of Hawaii accepts the donation of Lot 117 -A, containing an area of 0.621 acre situate at
`Ola`a, in the District of Puna, County and State of Hawai`i, identified as being a portion of Tax Map
Key: (3)1 -8- 005:125, more particularly described in Exhibit "A" and delineated on Exhibit "B"
attached hereto.
BE IT FURTHER RESOLVED that a letter of appreciation be sent to William H. Flammer III,
Trustee, P.O. Box 1060, Kula, Hawaii 96790.
BE IT ALSO RESOLVED that a copy of this resolution be forwarded to:
(1) Mayor William P. Kenoi; (2) Director of Public Works Warren H.W. Lee; (3) Deputy Corporation
Counsel Gerald Takase; and (5) William H. Flammer III, Trustee, P.O. Box 1060, Kula, Hawaii
96790.

Land situated at Olaa, Puna,
County of Hawaii, Hawaii.
Beginning at a survey pipe found at the northerly comer of this parcel of land, said comer
being the north corner of Lot 117 at the southwest right -of -way of North Pszyk Road, 50
feet wide, said Point of Beginning referred to Government Survey Triangulation Station
"OLAA" being 17,847.99 feet South and 20,448.01 feet West, thence running by
azimuths measured clockwise from true South:
1. 318° 40' 00" 653.23 feet along the southwesterly right -of -way of North Pszyk
Road, 50 feet wide to a pipe set;
2. 105° 40' 00" 86.37 feet along the northeasterly boundary Lot 117 -B;
3. 151° 30' 20" 164.99 feet along the northeasterly boundary Lot 117 -B;
4. 128° 08' 25" 427.13 feet along the northeasterly boundary Lot 117 -B and Lot
117 -D to a pipe set at the southeasterly boundary of Lot
118;
5. 228° 40' 00" 88.41 feet along Lot 118 to the Point of Beginning, enclosing an
area of 0.621 acres, more or less.
