REPORT OF THE
COMMITTEE ON PLANNING
Your Committee on Planning, to which was referred Bill No. 227, reports as follows:
Bill No. 227, transmitted via Communication No. 754 from Mayor William P. Kenoi, dated
February 25, 2010, presents a Change of Zone Request by William and Glynnis Dolan, at
Ponahawai, South Hilo, Hawai`i, TMK: 2 -3- 037:014.
Bill No. 227 seeks to amend Section 25 -8 -33 (City of Hilo Zone Map), Article 8, Chapter 25
(Zoning Code) of the Hawai`i County Code 1983 (2005 Edition), by changing the District
Classification from Agricultural —1 Acre (A -1a) to Neighborhood Commercial — 20,000 square
feet (CN -20) for approximately 3.258 acres of land.
There was no public testimony. Applicants were represented at the meeting by Mr. Gillie Silva.
Council Member Brenda Ford queried if the applicant was aware of the flood channel on the
property. Mr. Silva indicated the applicant was well aware of the flood channel on the subject
property. Council Member Ford asked Mr. Silva how the applicant intended to provide egress
and ingress since the property was landlocked. Council Member Ford was informed that she was
incorrect, that the access to the property was on Ponahawai Street. There was no further
discussion on the matter.
Your Committee concurs with the Windward Planning Commission' and the Planning Director's
favorable recommendation for approval of the Change of Zone request.
It should be noted that Council Member Brenda Ford voted "kanalua" two times.
