REPORT OF THE
COMMITTEE ON PLANNING
Your Committee on Planning, to which was referred Bill No. 228, reports as follows:
Bill No. 228, transmitted via Communication No. 755 from Mayor William P. Kenoi, dated
February 25, 2010, presents a Change of Zone Request by Gillie and Jane Silva, at Ponahawai,
South Hilo, Hawai`i, TMK: 2 -3- 037:006.
Bill No. 228 seeks to amend Section 25 -8 -33 (City of Hilo Zone Map), Article 8, Chapter 25
(Zoning Code) of the Hawai`i County Code 1983 (2005 Edition), by changing the District
Classification from Agricultural —1 Acre (A -1 a) to Neighborhood Commercial — 20,000 square
feet (CN -20) for approximately 5.075 acres of land.
There was no public testimony. Applicant, Mr. Gillie Silva, was present at the meeting.
Council Member Brenda Ford expressed confusion regarding the Department of Planning's
condition(s) for an easement that would allow interconnectivity with an adjoining parcel owned
by William and Glynnis Dolan. Council Member Ford stated that she would require the
applicants provide your Committee with a diagram indicating the required easement. A copy of
the portion of Exhibit 2, a map indicating the required easement, included in the applicants'
application, will be made available for your Committee members. There was no further
discussion on the matter.
Your Committee concurs with the Windward Planning Commission and the Planning Director's
favorable recommendation for approval of the Change of Zone request.
It should be noted that Council Member Brenda Ford voted "kanalua" two times.
