RESOLUTION NO. 331 10
A RESOLUTION TO STRONGLY URGE THE 2011 STATE LEGISLATURE TO
PROHIBIT RIDING IN THE BACK OF OPEN BED PICKUP TRUCKS AND
ENCOURAGE OUR FELLOW COUNTY COUNCILS TO JOIN THIS EFFORT.
WHEREAS, safety dictates the use of seatbelts in automobiles; and
WHEREAS, no seatbelts or other protection is available in the open bed of pickup
trucks; and
WHEREAS, potentially severe injury or death can and in fact has occurred in accidents
involving passengers riding in the open bed of pickup trucks; and
WHEREAS, perhaps 25 percent of the vehicles on our roads are pickup trucks; and
WHEREAS, Hawai`i Revised Statutes, section 291 -14, prohibits, with certain
exceptions, any person 12 years of age or under from riding in an open bed of a pickup truck;
now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it
strongly urges the 2011 State Legislature to prohibit any person from travelling or riding in the
open bed of a pickup truck on any public highway or road.
BE IT FURTHER RESOLVED that the Hawai`i County Council asks the county
councils of Kaua`i, Maui, and the City and County of Honolulu to provide similar resolutions to
the 2011 State Legislature.
BE IT FURTHER RESOLVED that the County Clerk shall forward copies of this
resolution to the Honorable Mayor William P. Kenoi; the Office of the Prosecuting Attorney; the
Police Chief of the Hawaii County Police Department; the Director of the Department of
Transportation, State of Hawai`i; the Chair of the Council of the City and County of Honlulu; the
Chair of the Kaua`i County Council; and the Chair of the Maui County Council.

BE IT FINALLY RESOLVED that upon the opening of the 2011 Hawai`i State
Legislature, the County Clerk shall forward copies of this resolution to the members of the
Senate, Hawaii State Legislature; the members of the House of Representatives, Hawaii State
Legislature; and the Honorable Governor of the State of Hawaii.
