RE: Resolution Urging the 2011 State Legislature to Prohibit Riding in the Back of
Open Bed Pickup Trucks
The attached resolution is directed to the 2011 Hawaii State Legislature and our fellow County
Councils of Kauai, Maui, and the City and County of Honolulu.
Hawaii Revised Statutes, section 291 -14, subsection (c) currently states:
"(c) No operator of any pickup truck may operate the vehicle with any passenger twelve years of
age or under in the bed or load - carrying area of the vehicle, unless one of the following applies:
(1) An emergency exists that threatens the life of the passenger being transported in the bed
or load - carrying area of the vehicle; or
(2) The vehicle is being operated in parades, caravans, or exhibitions which are officially
authorized or otherwise permitted by law."
The resolution calls for the 2011 State Legislature to prohibit any riding in the back of open bed
pickup trucks.
It further asks the county councils of Kaua`i, Maui, and the City and County of Honolulu to join
the Hawai`i County Council in shared support of this message to the 2011 State Legislature.
Please place this resolution on the appropriate committee agenda for those meetings scheduled
for May 4, 2010.
