Subject: Transmittal of a Bill for an Ordinance Amending Chapter 5, Article 2, of the Hawaii
County Code 1983 (2005 Edition, as amended)
Please find attached a bill for an ordinance amending chapter 5, article 2, of the Hawai`i County Code
1983 (2005 Edition, as amended).
The purpose of this ordinance is to revert back to some previously amended 2006 IECC language
that, for example, allows for certain requirements for unconditioned buildings to be exempt and to
correct technical errors, as proposed by the architectural community.
Due to the time - sensitive nature of these amendments, this matter will be waived from committee.
Please place on the May 5, 2010, council agenda.

RE: Bill No. 750 : A Bill to Amend Chapter 5, Article 2, Hawai`i County Code 1983
(2005 Edition, as amended); Relating to the International Energy Conservation Code.
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above - referenced matter be
waived from the Public Works and Intergovernmental Relations Committee to the full Council
for immediate action. In reviewing this matter, timely approval is crucial. It is therefore
advantageous that approval is granted and the matter be placed onto the next Council agenda for
review. However, in the event this request is denied, for whatever reason, I understand the
matter shall be referred to the Public Works and Intergovernmental Relations Committee for
placement on its future agenda.
