The amendments are illustrated below via Ramseyer format. A draft copy of Resolution No. 318 -10 Draft 2, is attached with the amendments incorporated therein. They are as follows: 1. Amending the ninth whereas clause, to read as follows: "...the FINAL Integrated Resources and Solid Waste Management Plan[]; and" 2. Adding the following three whereas clauses after the last whereas clause, to read as follows: "WHEREAS, on December 3, 2009, Hawaii Tribune Herald article, Mayor William Kenoi stated "The county has no intention of implementing a pay -as -you -throw fee at solid waste transfer stations in the near future, Mayor Billy Kenoi said Wednesday. "; and WHEREAS, the Hawaii County Council agrees with the Mayor's sentiment, and will not propose pay -as- you -throw as a method to derive revenues for the County of Hawaii; and WHEREAS, although the pay as you throw program is documented in the Integrated Resources and Solid Waste Management Plan due to the suggestion by the CH2MHil1 consulting company, and the Solid Waste Advisory Committee, the Council hereby proclaims that any reference to pay -as- you -throw in the Integrated Resources and Solid Waste Management Plan is not supported nor will it be implemented by the County of Hawaii; and" 3. Adding a be it further resolved clause to be inserted as the second be it further resolved clause, to read as follows: "BE IT FURTHER RESOLVED that the Council hereby proclaims that any reference to pay -as- you -throw in the Integrated Resources and Solid Waste Management Plan is not supported nor will it be implemented by the County of Hawaii. To Ref, Dote R 23 an RESOLUTION AUTHORIZING THE ACCEPTANCE BY THE COUNTY OF HAWAII OF THE INTEGRATED RESOURCES AND SOLID WASTE MANAGEMENT PLAN UPDATE FOR THE COUNTY OF HAWAII WHEREAS, Chapter 342G, Part III, §342G -21, et seq., Hawaii Revised Statutes, entitled Integrated Solid Waste Management Planning, requires that each county is to submit to the Office of Solid Waste Management of the State Department of Health an integrated solid waste management plan that has been formally adopted by the County of Hawai`i and is consistent with the requirements of said Chapter 342G; and WHEREAS, on October 5, 1994, the County Council of the County of Hawai`i adopted Resolution 291 -94, which authorized the acceptance of the Integrated Solid Waste Management Plan; and WHEREAS, on November 20, 2002, the County Council of the County of Hawaii adopted Resolution 238 -02, which authorized the acceptance of the Final Draft Update to the Integrated Solid Waste Management Plan for the County of Hawai`i; and WHEREAS, Chapter 342G, Part III, Hawaii Revised Statutes, delineates the schedule and requirements for updating an integrated solid waste management plan; WHEREAS, in 2008, Mayor Harry Kim appointed a County of Hawaii Solid Waste Advisory Committee which was confirmed by the County Council of the County of Hawai' i; WHEREAS, CH2MHil1 has prepared this update to the Integrated Solid Waste Management Plan for the County of Hawai`i in consultation with the County of Hawai' i's Solid Waste Advisory Committee; and WHEREAS, Public meetings were conducted in Hilo and Kona to review the DRAFT Integrated Resources and Solid Waste Management Plan; WHEREAS, the Office of Solid Waste Management of the State Department of Health has provided comments to the County of Hawai' i Department of Environmental Management on the DRAFT Integrated Resources and Solid Waste Management Plan; and WHEREAS, the County of Hawaii Department of Environmental Management has provided a formal response to the comments provided by the Office of Solid Waste Management of the State Department of Health, and has incorporated the necessary revisions in the FINAL Integrated Resources and Solid Waste Management Plan; and WHEREAS, on December 3, 2009, Hawai`i Tribune Herald article, Mayor William Kenoi stated "The county has no intention of implementing a pay -as- you -throw fee at solid waste transfer stations in the near future, Mayor Billy Kenoi said Wednesday. "; and WHEREAS, the Hawai`i County Council agrees with the Mayor's sentiment, and will not propose pay -as- you -throw as a method to derive revenues for the County of Hawai`i; and WHEREAS, although the pay as you throw program is documented in the Integrated Resources and Solid Waste Management Plan due to the suggestion by the CH2MHi11 consulting company, and the Solid Waste Advisory Committee, the Council hereby proclaims that any reference to pay -as- you -throw in the Integrated Resources and Solid Waste Management Plan is not supported nor will it be implemented by the County of Hawai`i; and NOW, THEREFORE, BE IT RESOLVED that in order to comply with Chapter 342G, Hawai`i Revised Statutes, as amended, the County Council of the County of Hawai`i hereby adopts the Integrated Resources and Solid Waste Management Plan, prepared by CH2MHill, and dated December 2009. BE IT FURTHER RESOLVED that pursuant to Chapter 342G, Hawaii Revised Statutes, as amended, the County of Hawai' i Integrated Resources and Solid Waste Management Plan shall be submitted to the Office of Solid Waste Management of the State Department of Health. BE IT FURTHER RESOLVED that the Council hereby proclaims that any reference to pay -as- you -throw in the Integrated Resources and Solid Waste Management Plan is not supported nor will it be implemented by the County of Hawai`i. BE IT FURTHER RESOLVED that copies of this resolution be transmitted to the Honorable Linda Lingle, Governor, State of Hawai`i; Dr. Chiyome L. Fukino, Director, Department of Health; William P. Kenoi, Mayor; County of Hawai`i; and Lono A. Tyson, Director, Department of Environmental Management, County of Hawai`i.
